Campaigner George Turner will be allowed to make his case against communities secretary Eric Pickles’ 2014 decision to approve the scheme.

Developer Braeburn Estates – a joint venture of Canary Wharf Group and Qatari Diar – intends to create seven apartments, about 76,000 square metres of office space, 110,000 square metres of residential space, and 6,000 square metres of shops, restaurants and cafés on the site on London’s South Bank.

Pickles agreed with a planning inspector that the proposals should be approved and a High Court judge earlier this year backed his decision and rejected a legal challenge by Turner.

However, the Court of Appeal has now agreed to hear Turner’s challenge.

Turner said this week: “I have heard news that the Court of Appeal have given me permission to take my case forward.

“The decision destroys the argument put out by my opponents that the case has no merit and has been thoroughly and properly considered”.

Braeburn Estates said it was “very disappointed” by the news.

“[The scheme] has already been through an exhaustive planning process, which included a year-long public consultation, followed by approval from Lambeth Council, the mayor of London and the communities secretary. A previous High Court challenge against the secretary of state’s decision has already been dismissed,” it said.

“The redevelopment of the Shell Centre site will bring many benefits and regeneration to this important part of London and this latest appeal will delay them further.”
