U.S. appeals court rejects challenge to Shell spill plans in Alaska

Business News | Thu Jun 11, 2015 3:47pm BST

A divided federal appeals court rejected an effort by environmental groups to void a U.S. agency’s approval of two oil spill response plans by Royal Dutch Shell Plc (RDSa.L) related to the company’s oil leases in the Beaufort and Chukchi seas on Alaska’s Arctic coast.

By a 2-1 vote, the 9th U.S. Circuit Court of Appeals on Thursday rejected a claim that the federal Bureau of Safety and Environmental Enforcement, which is part of the Department of the Interior, acted unlawfully in approving the plans, which relate to leases from 2005, 2007 and 2008. read more

Oil major Shell is considering withdrawing from its last exploration well in Ukraine as the project has been on hold for nearly a year due to the conflict between pro-Russian separatists and Ukrainian forces.

Shell said it has been unable to perform its commitments in relation to the Yuzivska production sharing agreement (PSA) with project partner Nadra Yuzivska LLC due to a force majeure that has been in place since last July.

“We have begun discussions with the Ukrainian government and our partner Nadra Yuzivska LLC on the way forward with the PSA,” Shell said in a statement. read more

Michael Squire explains Shell Centre model to planning inspector John Braithwaite watched by George Turner for residents (far left) and Robert Ayton for Westminster (far right)

George Turner told BD today’s defeat was “totally crushing” and admitted it was probably the end of the road for his efforts to halt the Shell Centre redevelopment.

Speaking at the Royal Courts of Justice straight after the judgement, he warned the public would come to question how the £1.2bn Squire & Partners scheme was built. read more

Nigerian auditors find NNPC failed to remit $11.6 bil in LNG export revenue

NNPC holds 49% equity in NLNG on behalf of the Nigerian government, with partners Shell (25.6%), Total (15%) and ENI (10.4%.)

11 June 2015

State-owned Nigerian National Petroleum Corporation has not remitted $11.6 billion in dividends and loan and interest repayments earned from exports from the Bonny LNG plant from 1999-2012, the country’s oil industry auditors said late Tuesday.

NNPC could not immediately be reached for comment Wednesday.

The Nigerian Extractive Industry Transparency Initiative, or NEITI, said in a statement that the earnings represent NNPC’s share of 49% equity ownership in Nigeria LNG Ltd., owner of the six-train, 22 million mt/year Bonny LNG plant. read more

Shell calls ‘Force-Majeure’ on Ukraine project

Sources familiar with the situation said Ukraine’s government received a “Notice of Withdrawal” from Shell on a project that they had hoped could raise up to $10bn of investment and further diversify gas imports away from Russia, Roman Olearchyk reports from Kiev.

Shell said it “has been prevented from performing its commitments under Yuzivska [a production sharing agreement] for an extensive period of time due to Force-Majeure, i.e. circumstances beyond Shell’s control.” Due to the said events, project implementation conditions have been materially changed. Therefore, we have begun discussions with the Ukrainian government and our partner Nadra Yuzivska LLC on the way forward with the PSA, pursuant to its terms. read more

Seattle activists opposed to Arctic drilling have vowed to launch a kayak blockade to prevent the departure of Shell’s drilling rig, and said they have hundreds of protesters standing to hit the water as soon as the Polar Pioneer departs.

“Our effort is to create as large a flotilla as we can to make it impossible for them to get permission to leave,” Bill Moyer, executive director of the Backbone Campaign, an environmental justice organization, told Al Jazeera on Wednesday. read more

A group of oil companies has come to an agreement with victims of the 2013 oil train derailment in Quebec, Canada.

The train had been carrying 7.7 million litres of crude oil when it crashed, resulting in a massive spill and an explosion that killed 47 people.

Royal Dutch Shell, Marathon Oil Corp, Conoco Phillips and Irving Oil were all named by The Wall Street Journal as contributing. It is not clear how much each company will contribute.

It has been reported the settlement was reached in bankruptcy court to avoid costly and lengthy court processes. read more
