Sir Phil was to blame for scandal

Sir Phil Watts, the former chairman of Shell, will probably go to his grave mumbling that the reserves scandal of 2004 which wiped billions off the value of the company had absolutely nothing to do with him.

Yesterday he lost an FSA tribunal case where he argued that he had been denied his right to reply when the financial regulator censured Shell for engaging in “unprecedented misconduct” and fined it a record £17m.

The censure did not name Watts, but the former Shell boss, who was forced to resign after the scandal, argued that it was an attack on his leadership, that the FSA allowed him to be identified in the media and damaged his reputation. read more

Former Shell chairman Sir Philip Watts has lost an appeal against the UK’s city watchdog over how it handled the probe into Shell’s oil reserves crisis.

Sir Philip was forced to step down in January 2004 after the oil giant cut its reserves estimates by 20%.

Sir Philip accused the Financial Services Authority (FSA) of violating his rights by fining Shell £17m without giving him the opportunity to respond.

In avoiding being derailed by a legal challenge from Sir Philip Watts, former chairman of Royal Dutch Shell, the Financial Services Authority yesterday scored a notable victory.

Yet because his application fell at the first hurdle, more significant obstacles may still trip up the regulator in its efforts to combine fast action against companies with pursuit of individuals.

Sir Philip had argued that the FSA treated him prejudicially by failing to involve him in the procedures behind its decision to fine the Anglo-Dutch oil group £17m for mis-stating its oil and gas reserves. Even though the notices issued by the FSA did not single him out, he argued that anyone reading them would understand they were criticising individuals seen as responsible for the conduct at the heart of the watchdog’s complaint. read more

(Brazil)-Royal Dutch Shell has begun drilling a new evaluation well at its Brazilian BC-10 block and hopes to declare it commercially viable by the end of 2005. In an interview with Reuters, Shell Brazil Vice-President John Haney said that two wells will be drilled by November at a cost of $15 million per well. The BC-10 block has recoverable reserves of some 400 mmbbl of heavy oil.

Haney went on to say that the general concept of the project will likely include a floating production, storage and offloading unit (FPSO) with an artificial lifting system, risers for ultra-deep recovery and an onboard heavy oil processing system. The capacity of the FPSO is still under discussion, although the field is expected to produce between 60,000 and 100,000 b/d beginning in 2009. read more

Shell wins auction of Turkish refinery

Energy Business Review: Shell wins auction of Turkish refinery

A consortium including Anglo/Dutch oil company Shell has won a hotly contested privatization auction of Turkish refiner Tupras with a bid reported to be just over $4 billion.

Wednesday 14 Sept 2005

13 Sep 2005, 17:41 GMT – According to reports Shell and its consortium of local allies led by Koc Holdings beat eight other suitors with their offer of $4.14 billion to secure a 51% ownership of state-owned Turkish Petroleum Corp. (Tupras). The major asset of the acquisition is a 500,000 barrels-a-day refinery in the eastern European state.

However, the competition was fierce as pre-auction predictions valued Tupras at over a billion dollars less than Shell’s winning bid. Saving and Serving Lives in the aftermath of Hurricane Katrina

“In view of recent publicly made allegations against Shell management that it has displayed racist policies towards its former employees in Malaysia…”

Tuesday 13 Sept 2005 16.48 PM EDT

By Dr John Huong (Also published on “Tell Shell”)

I would like to convey through the medium of the Tell Shell forum my condolences in respect of the poor souls in the Gulf States of the USA who tragically lost their lives as a result of Hurricane Katrina. I pray for relatives and friends of the deceased and for the huge number of people who have lost everything and now find themselves living as refugees a long way from their homes.

There has been some criticism of the oil companies for giving alleged derisory donations to assist in the response to this unprecedented natural disaster in North America. I understand (correct me if I am wrong) that my former employer Shell has given $1 million USD. In view of recent publicly made allegations against Shell management that it has displayed racist policies towards its former employees in Malaysia (which I am sure must be unfounded), I would respectfully suggest that Shell could dispel any such notion by making a much more significant donation to the charities supporting the refugees, many of whom are impoverished. read more

Tribunal setback for Shell ex-chief Sir Philip Watts

London Evening Standard: Tribunal setback for Shell ex-chief: FORMER Shell chairman Sir Philip Watts has suffered a major setback in a bid to restore his battered reputation

Tuesday 13 September 2005

Nick Goodway,

FORMER Shell chairman Sir Philip Watts has suffered a major setback in a bid to restore his battered reputation.

He had claimed the Financial Services Authority blackened his name by association in its report on how the oil giant had massively overstated its reserves.

Watts, who was not named in the report but was clearly referred to, claimed the watchdog should have given him the right to defend himself against the allegations.

But the Financial Services and Markets Tribunal today dismissed his case, saying it agreed with the FSA that, while Watts was identifiable in the ‘matter’ of the Shell case, he was not actually identified in the notice issued by the FSA. read more

Shell faces fresh prosecution

News.com.au (Australia): Shell faces fresh prosecution

“SHELL Australia is facing fresh prosecution over licence breaches at its Geelong refinery.”

Monday 12 Sept 2005

From: AAP

September 12, 2005

SHELL Australia is facing fresh prosecution over licence breaches at its Geelong refinery.

Victoria’s environment protection authority has criticised the poor environmental performance of the company’s jetty operations. Shell has no documented plan to deal with a tanker hitting the refinery jetty, an accident that could release hundreds of thousands of litres of hydrocarbons into Corio Bay, an EPA Victoria audit has found.

There was an unacceptably high risk that spilt oil could damage the marine fauna and the shore surrounding the jetty, the audit found. read more

Oil communities seek gas flares end by 2006

FROM OUR AUGUST 2005 SHELL NEWS ARCHIVE

Daily Independent (Nigeria): Oil communities seek gas flares end by 2006

“One of the oil majors, Shell Petroleum Development Company (SPDC), recently shifted its date to end the problematic gas flaring to 2009 ending from the earlier proposed 2008 date.”

Posted Monday 12 Sept 2005

By Akanimo Sampson

Bureau Chief, Port Harcourt

Voices of dissent appear to herald moves by oil multinationals to end gas flaring in the Niger Delta area in three years time, with several of the oil communities preferring a 2006 date.

One of the oil majors, Shell Petroleum Development Company (SPDC), recently shifted its date to end the problematic gas flaring to 2009 ending from the earlier proposed 2008 date.

The latest claim by Oilwatch Africa, a network of environmental human rights groups, revealed that most oil communities in the region are pushing for an end to gas flares not later than 2006. read more

The Green Party has called for a full oral hearing into the Corrib onshore gas pipeline in an attempt to break the impasse over the imprisonment of five Mayo residents.

The north Mayo men opposed to the pipeline are now spending their 11th week in prison and are due back in court on October 4th.

Irish Independent: Pipeline pressure

Irish Independent: Pipeline pressure

“It says a lot about the way Ireland is being run when people’s safety is disregarded in favour of a multinational corporation’s interests and people are jailed by the State for voicing those concerns.”

Monday Sep 12, 2005

Sir – Well done to David McKittick for highlighting the issues involved in the dispute between Shell and the Rossport Five (Features). If the claims are true about the possible pressures in the pipeline, then in my opinion the men are justified in their safety concerns. Shell state that the pipe pressure may never reach 345 bar, but even a quarter of that is a very high pressure. To put it into context, a car tyre would only go to about 20 bar. You can imagine what sort of a bang you would get if a pipe joint failed at say 100 bar. Add to that the fact that you are dealing with a flammable gas and anyone can see the dangers. Would you like this in your back garden? Would this have been brought ashore off the coast of Dublin, through Blackrock for example? I think not. Why was it even given planning permission? read more

The Wall Street Journal: Shell Ties Woes Of Russia Project To Lack of Data

YUZHNO-SAKHALINSK – Executives at the Royal Dutch Shell PLC-led Sakhalin II project, a Russian oil and natural-gas project that Shell said in July could cost $20 billion, or roughly €16 billion, twice as much as expected, partly attribute the overruns and delays to going ahead with insufficient information.

In interviews, managers at the Shell-led joint venture said this meant the company didn’t properly model the geology of the area and was unprepared for the effect of ice on the pipeline and environmental concerns. Shell already said in July that overly optimistic assumptions by its managers led to the revised costs and schedule. The company also said then that industrywide cost inflation and unforeseen technical and environmental challenges had a role. read more

ROYAL DUTCH SHELL ROBBERS AND RASCALS

ROYAL DUTCH SHELL ROBBERS AND RASCALS

“…Shell shareholders have to foot the bill for lawyers fees run up in the course of defending fat cat crooks, such as Sir Phillip Watts, the disgraced former Group Chairman of the Royal Dutch Shell Group. Sir Phillip ended up with a $18 million USD pension pot AND with all his ongoing legal fees being paid by Shell shareholders. This was after he had LIED AND COVERED UP THE TRUTH ABOUT SHELL’S RESERVES, AND IN THE PROCESS, DESTROYED SHELL’S REPUTATION”

By Alfred Donovan: Monday 12 Sept 2005

The press is having a field day in devising colourful headlines about the scandal ridden Royal Dutch Shell Group. An article in “The Sunday Times” yesterday had a story under the headline: “Shell move robs UK investors”. It reported on the horrendous tax implications for UK Royal Dutch shareholders resulting from the recent Royal Dutch/Shell unification and the dubious way in which Shell has dealt with the controversy thus far.

Yesterdays “Independent on Sunday” used the term “Clever Rascals” about Shell in a headline relating to the Sakhalin project in Russia and the potential ramifications in respect of the critically endangered western grey whale. For the record, the Encarta Online Dictionary definition of a “rascal” is: “dishonest person: somebody, especially a man, who is dishonest or otherwise unethical”. read more
