Oil once flowed in Ogoniland, as it does from wells throughout the creeks and swamps of Nigeria’s Niger Delta region.

But in 1993, the Ogoni people said enough. Leaking pipelines were polluting the fields they farmed and the waterways they fished.

Oil giant Shell was forced to pull out of Ogoniland that year in the face of protests led by the charismatic Ken Saro-Wiwa, head of the Movement for the Survival of the Ogoni People, or MOSOP. He was hanged two years later by the military dictatorship that ran Nigeria, in a move widely seen as retaliation for his activism. read more

Kiobel v. Shell ruling: serious setback to Ogoni in Niger Delta

The ruling, which was handed down last Wednesday, is seen as a serious setback for the Ogoni community in the Niger Delta, who alleged gross human rights abuses during the mid-1990s by the military government in power at the time.

Ogoni Autonomy Gets D-Day

General Assembly sets 2nd August 2012 for Ogoni Political Autonomy

The date to decide the destiny of Ogoni people in southern Nigeria is set to be on the 2nd of August, 2012.

It means Ogonis will observe every 2nd of August each year as a day of internal independence in Nigeria.

This will be the first time that the Ogoni people will exercise self-determination in almost 111 years.

Nigeria: Ogoni Is Poised To Enforce United Nations Declaration

A national conference to groom newly elected representatives on how to enforce the United Nations Declaration on Rights of Indigenous Peoples will open in Bori on the 31st of July, 2012.

The conference was originally scheduled for July 22, 2012, but was shifted to include all Ogonis as participants.

The conference will feature workshops, roundtables and dialogue on economic, social, political and security issues as well as traditional displays.

Over 2,500 leaders have been elected to enforce the rights of indigenous peoples at the village level, while 120 representatives secured mandate to run 33 newly created administrative districts. 24 custodians of customs and traditions were also elected to take their seats at the central level as law makers. read more

Port Harcourt — The Shell Petroleum Development Company (SPDC) shut down its office in Rumoumasi area of Port Harcourt, Rivers State, as hundreds of Ogonis and environmental activists staged a protest at the weekend.

The protesters, who carried placards with various inscriptions such as, “Shell clean up Niger Delta”, “Implement UNEP report”, “Ogoni say no to Shell”, among others, marched to the entrance of the Shell office, calling on it to clean up pollution in the Niger Delta region. read more

This past October, a 15-year legal battle between Royal Dutch Petroleum and a Nigerian political movement finally went before the Supreme Court — of the United States, that is. On October 17, the Court decided to hear a lawsuit filed by Esther Kiobel, whose husband, Dr. Barinem Kiobel, was one of nine activists from the Movement for the Survival of the Ogoni People hanged by Sana Abacha’s military government on November 10, 1995. Kiobel alleges Shell was partly responsible for her husband’s death, and for other human rights violations committed in the oil-rich Ogoniland region. read more

Almost as soon as the U.S. Court of Appeals for the Second Circuit concluded last year in Kiobel v. Royal Dutch Petroleum that corporations are not liable in U.S. courts under the Alien Tort Statute for abetting overseas atrocities, the ruling looked like U.S. Supreme Court bait. As I’ve reported, the D.C. Circuit, the Eleventh Circuit, and the Seventh Circuit have all come to the opposite conclusion about corporate liability under the ATS. The only question was which ATS case the high court would choose as the vehicle for deciding whether corporations can be sued for helping foreign governments violate international human-rights law. read more

WASHINGTON (AP) — The Supreme Court says it will use a dispute between Nigerian villagers and oil giant Royal Dutch Shell to decide whether corporations may be held liable in U.S. courts for alleged human rights abuses overseas.

The justices said Monday they will review a federal appeals court ruling in favor of Shell. The case centers on the 222-year-old Alien Tort Statute that has been increasingly used in recent years to sue corporations for alleged abuses abroad.

The villagers argue Shell was complicit in torture and other crimes against humanity in the country’s oil-rich Ogoni region in the Niger Delta.

A divided panel of federal appeals court judges in New York said the 18th century law may not be used against corporations. More recently, appellate judges in Washington said it could.

Shell’s horrendous track record in Nigeria includes embedding spies in the Nigerian government; paying rival militant gangs; engaging in corruption (not only in Nigeria); arming police spies; using a private spy firm (Hakluyt) partly owned and controlled by Shell directors, to infiltrate Nigerian activists (friends of Ken Saro-Wiwa) and linking Shell with murder and human rights abuses which are the subject of the above case. Questions inevitably arise about financial linkage to Shell of the militants responsible for the repeated attacks against Shell pipelines and infrastructure over many years, which has driven up the cost of oil. Shell battles its North Sea oil spill from pipeline below the Gannet Alpha platform

Shell is facing a burgeoning image crisis as its North Sea oil spill – the biggest in British waters for a decade – stretched into its seventh day.

The Anglo-Dutch giant has been using teams of divers and Remote Operated Vehicles (ROVs) to battle the leak, which is estimated to have slowed from five barrels a day to two.

But initial work on the sub-sea pipeline below the Gannet Alpha platform succeeded only in plugging one part of the damaged pipe, forcing oil out elsewhere.

The company estimates that some 1,300 barrels of oil have been spilt so far.

In the context of BP’s oil spill in Gulf of Mexico last year – which saw an estimated 4.9m barrels of oil gush into US waters – Shell’s leak is relatively small. read more

The Supreme Court is expected to decide within weeks whether it will hear a case on the liability of U.S. corporations for human rights violations in other countries.

The issue has simmered for years as human rights advocates accused corporations of abusing residents of mineral rich areas overseas to evade U.S. laws that never would allow the same kind of exploitation.

We have printed below an email we have received purportedly from MOSOP President Dr Goodluck Diigbo replying to corruption allegations made against him.  The”Amaechi”mentioned in the email is a reference to Chibuike Amaechi, Governor of Rivers State in Nigeria.

At a MOSOP Emergency General Meeting in Bori, headquarters of Ogoniland on August 4, 2011, MOSOP welcomes the increased awareness the UNEP report on Ogoniland is likely to create about the continued threat of possible extinction to the Ogoni people arising from oil operations in the past 55 years. However, MOSOP resolves to dispute the integrity of the UNEP Report on Ogoniland, which was paid for with $9.5 million by the polluters, including Royal-Dutch/Shell.

MOSOP President/Spokesman, Dr. Goodluck Diigbo, says MOSOP is challenging the integrity of the report, recalling an earlier confession by UNEP team leader Mike Cowing that the report has been informed by data and information solely supplied by Shell and the government, without actual study on the ground. The purported UNEP meeting with 23,000 Ogonis is only on paper, and there is no evidence to prove who attended, what review was done, agreements reached, if any and Ogonis who signed such agreements as proof of public participation as part of the Environmental Impact Assessment Study, EIAS due process. read more

Oil was first found in Nigeria in 1956, then a British protectorate, by a joint operation between Royal Dutch Shell and British Petroleum. The two begun production in 1958, and were soon joined by a host of other foreign oil companies in the 1960s after the country gained independence and, shortly after, fell into civil war.

The rapidly expanding oil industry was dogged in controversy from early on, with criticism that its financial proceeds were being exported or lost in corruption rather than used to help the millions living on $1 a day in the Niger delta or reduce its impact on the local environment. read more

Shell faces a bill of hundreds of millions of dollars after accepting full liability for two massive oil spills that devastated a Nigerian community of 69,000 people and may take at least 20 years to clean up.

Experts who studied video footage of the spills at Bodo in Ogoniland say they could together be as large as the 1989 Exxon Valdez disaster in Alaska, when 10m gallons of oil destroyed the remote coastline.

Until now, Shell has claimed that less than 40,000 gallons were spilt in Nigeria. read more

The Environmental Rights Action/Friends of the Earth Nigeria (ERA/FoEN) and other civil society groups have cautioned the United Nations Environment Programme (UNEP) from further prevarication on the planned release of its two-year assessment of the environmental and public health impacts of oil spills in Ogoniland.

In a statement issued in Lagos, ERA/FoEN said the people of Ogoniland and the entire Niger Delta are becoming worried over UNEP’s continued delay in releasing the report after failing to honour a pledge to do same earlier in the year. read more

Shell’s $15.5m settlement: the robber barons knocking at the Ogoni door

The Ogoni people are being played for fools. A few will become rich as a result of the so-called settlement, while the vast majority will remain poor and pitilessly exploited, as always.

Read between the lines of what Shell Executive Malcolm Brinded has said in the carefully co-ordinated media campaign.

“We believe this settlement will assist the process of reconciliation and peace in Ogoniland, which is our primary concern.” 

The real purpose of the paltry $15.5 million is as a re-entry fee to once again plunder the hydrocarbon riches of the Niger Delta: an entry payment for future exploitation, not compensation or genuine atonement for past sins. Note that many other Shell related stories were generated yesterday by the Shell propaganda machine in an unsuccessful attempt to bury news of the so-called settlement. read more
