Four local residents have initiated a legal challenge to the Environmental Protection Agency’s decision granting Shell E&P Ireland an INDUSTRIAL EMISSIONS LICENCE P0738-03 for the Corrib gas refinery in Co Mayo.

A Dutch appeals court has ruled that Royal Dutch Shell can be held liable for oil spills at its subsidiary in Nigeria, potentially opening the way for other compensation claims against the multinational.

Judges in The Hague ordered Shell to make available to the court documents that might shed light on the cause of the oil spills and whether leading managers were aware of them.

A lower Dutch court in 2013 had found that Shell’s Dutch-based parent company could not be held liable for leakages of oil at its Nigerian subsidiary. read more

Four local residents have initiated a legal challenge to the Environmental Protection Agency’s decision granting Shell E&P Ireland an Integrated Pollution Prevention and Control Licence (IPPC)for the Corrib gas refinery in Co Mayo.

The EPA granted the IPPC licence for the Bellanaboy Bridge gas terminal, a gas refinery and large combustion plant designed to process 9.9 million cubic meters of natural gas per day.

When operational, the refinery will treat gas transported via a 65km pipeline from the offshore Corrib gas field before it is discharged via a pipeline into the existing Bord Gais gas network. read more

Yesterday, operator Shell E&P Ltd confirmed that the 2015 spend by the Corrib partners on the field will be €260m.

Some €320m was spent last year, as total costs approach €3.6bn by the end of 2015.

A spokesman for Shell Ireland said: “As construction of the Corrib development is essentially completed, the capital investment in the project will reduce significantly from 2016 onwards.

“The Corrib facilities have been technically ready to start up since September 1 last.

“After what has been a protracted development phase, Shell is understandably eager to start producing gas as soon as possible. read more

The company behind the controversial Corrib gas project racked up losses of over €98m last year as it awaits a final government permit to begin flowing gas at the site.

Accounts just filed for Shell E&P, the Shell subsidiary managing the project in Ireland, show administrative costs amounted to €18.8m last year, down from €20.3m in 2013.

It made an operating loss of just over €26m compared to €28.5m the year before. Most of the loss was an actuarial loss that related to the firm’s pension scheme. read more

Almost 40 security staff at the Corrib Gas Terminal in north Mayo have begun industrial action in a dispute over payments and terms of employment.

The personnel involved in the one-day stoppage at the Bellanaboy facility are all members of SIPTU.

Those taking part in the dispute are employed by the Senaca Group, a security services firm, which is contracted by Shell E&P Ireland to safeguard its operations in Co Mayo. 

SIPTU has said the workers are taking the action after a number of contracts were terminated and working hours were unilaterally reduced in recent weeks. read more

Controversial Corrib gas will flow within weeks

Penultimate permission granted by EPA

ALMOST two decades after its discovery, the Corrib Gas field  has been given its penultimate permission, an industrial emissions licence, by the EPA (Environmental Protection Agency). The final statutory permission for the €3.6bn project is expected to be issued very soon by the Minister for Communications, Energy and Natural Resources, Alex White, clearing the way for the gas to flow from the Bellanaboy refinery.   read more

Like many others, I was sceptical when in July, Prime Minister David Cameron said in a speech in Singapore he was planning to crack down on corrupt foreigners who own luxury properties in London and use the capital as a place to launder dirty cash.

It’s easy to say that ‘the UK must not become a safe haven for corrupt money from around the world,’ but rather harder to act on, especially given the intricate networks of shell companies through which many of these properties are owned, and given the number of properties bought legitimately with money that has a less troubling provenance. read more

Shell granted licence by EPA for Mayo gas refinery

Shell has been granted an industrial emissions licence by the Environmental Protection Agency (EPA) for its gas refinery at Bellanaboy, Co Mayo.

The licence is one of the last consents required by the Corrib gas developers. The licence allows for “operation of a gas refinery” and “combustion of fuels”. It was issued by the agency on Thursday October 8th and has been posted on the EPA’s website.

In August the company submitted the application to the department for permission to operate the 91 kilometre-long high pressure pipeline in north Mayo under section 40 of the Gas Acts. read more

Interesting to read the two recent articles about Shell/Corrib on your site – Shell’s arrogance, plus their presumption of statutory and ministerial subservient compliance still reign supreme!

Shell could at least have made a cursory acknowledgement of a person’s right to recourse to law by way of Judicial Review of the two presumed consents but, once again, they would appear to know something the rest of us don’t.

I would much appreciate if you could draw your reader’s attention to a Shell to Sea petition addressed to the line Minister Alex White which asks/demands that he refuse Shell consent to operate their ‘Space Shuttle syndrome’ refinery at Ballinaboy. As this is of local, national and global significance, I hope many readers will sign it over the next two days. read more

Shell Ireland yesterday declared that on-site work is complete for gas to flow from the Corrib gas field.

Shell E&P Ireland confirmed that from a technical point of view, production of gas can now start – 19 years after gas was discovered in the gas field off the coast of Mayo.

However, the Corrib Gas Partners cannot commence production until two separate permits are granted by the Environmental Protection Agency (EPA) and the Dept of Communications, Energy and Natural Resources. read more

Shell Ireland has officially applied to the Government for permission to operate the controversial pipeline from the Corrib gas field off the coast of Mayo.

The application is the first to be made under the Gas Act since the completion of its construction.

The pipeline is a joint venture by the Corrib Gas Partners which comprises Shell E&P Ireland Limited, Statoil, and Vermillion.

The application was sent to Minister for Communications, Energy, and Natural Resources Alex White on Tuesday, August 18. read more

Health and Safety Authority has referred the findings of its investigation into the death of a German national in the Corrib gas tunnel almost two years ago to the Director of Public Prosecutions (DPP).

The authority confirmed to The Irish Times yesterday that it has completed its investigation into the circumstances surrounding the death of Lars Wagner (26) in the tunnel under construction in north Mayo on September 8th, 2013.

Mr Wagner, who was single and from Offenburg in southern Germany, sustained fatal head injuries when a compressed air pipe reportedly came free. read more

Under oath, Mr Neil Rooney claimed that the first delivery of alcohol to Belmullet Garda Station was made in 2005, and that in 2007, he was asked by Conor Byrne, a Senior Pipeline Engineer with Shell, to make a large delivery.

Mr Rooney, from Downpatrick, Co Down, said he went to the north and bought £7,000 worth of alcohol. When Mr Byrne saw the amount of alcohol, Mr Rooney claimed he was told there were 300 gardaí in Erris and to get more. He said he bought another £18,000 worth of alcohol. read more

The jury in the trial of two Shell protesters were shown video footage of the protest where up to 70 protesters entered a Shell compound in north Mayo.

The video footage was captured by CCTV at the compound and by security officers policing the site when the protesters entered the Shell compound at Aughoose, Pollathomas in Co Mayo on June 23rd, 2013.

Gerry Bourke of Aughoose, Pollathomas Co Mayo and Liam Heffernan of Kilnagear, Belcarra, Castlebar, Co Mayo are on trial in Castlebar Circuit Criminal Court both charged with violent disorder and criminal damage as a result of the protest. read more

The Irish Police (the Garda) are currently investigating allegations of harassment by recipients of bribes made on behalf of Shell by its then “Mr Fixit” company, OSSL.

The directors of OSSL are the subjects of the investigation, which the Garda warns may result in criminal charges.

I note that the recipients of the bribes are not suing for defamation on the grounds that the bribery allegations are untrue, but instead are complaining bitterly about being constantly reminded by OSSL that they caved in to Shell corruption. They accepted valuable gifts to smooth the path of the troubled Corrib project.  read more

The Environmental Protection Agency (EPA) has turned down requests for an oral hearing into a revised licence sought by Shell E&P Ireland for the Corrib gas project in north Mayo.

The revised licence covering atmospheric and marine emissions from the Corrib gas refinery is one of the last State authorisations required before the project becomes fully operational.

Shell had received its original EPA licence in 2007, but sought a review after it agreed to a demand by Erris fishermen that “treated produced water” from the refinery be discharged out at the well head, rather than some 12 km offshore. read more

A lack of consultation and sensitivity to local concerns in the initial stages led gradually to resistance and confrontation. Smouldering resentment over what objectors regarded as unqualified state support for the developer caught fire when five protesters, concerned about the safety of a gas pipeline and its proximity to their homes, were jailed on an application from Shell. The €2.4 billion cost overrun is largely as a consequence of opposition to the project, which was stimulated in part by poor management of it at its outset.

The huge cost overrun on Corrib gas, the single most expensive energy infrastructure project in Ireland and the largest since the Ardnacrusha hydroelectric scheme on the Shannon in the 1920s, will deprive the Government of an estimated €600 million in tax revenue.

The €600 million represents 25 per cent of the project’s likely cost overrun of €2.4 billion, much of which was incurred because of changes made to the project since it began.

Had this additional €2.4 billion not been spent on development costs, an extra €600 million would have been paid to the exchequer as tax on profit, which for exploration companies is levied at 25 per cent. However, like all companies, Shell Exploration and Production Ireland, which is a partner with Statoil of Norway and Vermilion Energy of Canada, can write off capital development costs against taxation. read more

The mechanics of extracting gas from the Corrib field appear simple enough. It is only when one gets into the detail of the engineering that the complexities emerge.

This is an environment in which a relatively small number of people can spend years – in remote places such as Sakhalin Island in the far east of Russia, in the Middle East, or on rigs in the North Sea – living intense lives in dangerous conditions and sometimes speaking a language alien to others.

They talk about “slug catchers” and “intelligent pigs”, about Christmas trees at the bottom of the sea, and about “black starts” – no one wants a black start, but if you are going to operate a terminal like the one now being tested at Bellanaboy in Mayo, someday for sure, you are going to have to do a black start. read more

Gas is expected to come later this year to the Shell terminal in Bellanaboy, Co Mayo, through the controversial pipeline that rises from the Atlantic seabed 83km offshore. The terminal is currently being commissioned and tested. As gas passes through the terminal, impurities will be removed and pressure adjusted before the gas is pumped into the Bord Gáis network.

Outside the terminal, at Glengad and Aghoose, the start and end points of the 4.9km tunnel under Sruwaddacon Bay, work to restore the landscape is under way. read more

SHELL E&P Ireland has challenged facets  of nine conditions attached to the proposed revised Environmental Protection Agency’s (EPA) emissions licence for the Corrib gas project. The company is among seven other groups or individuals which have made  valid objections to the revised licence.    

The objectors include a group of 64 residents from members of communities living in Rossport, Pollathomas and Glengad. Over the last decade, they say they have experienced ‘spills, sinkholes, light and noise pollution, changes to the land and the waters and breaches of regulations’. read more

Last week 1100 people signed a petition calling on the Environmental Protection Agency (EPA) to reject Shell’s application for an Industrial Emissions Licence for the Shell/Corrib Gas refinery at Bellanaboy, Co Mayo. They have also called for an oral hearing to be held into the application. The petition was started by the Shell to Sea campaign and was hosted by the “Avaaz” community petitions website. [1]

Shell are currently unable to operate the Bellanaboy refinery as their earlier Emissions Licence was quashed by the High Court last year.  Martin Harrington successfully took the challenge on the basis that the EPA was wrong in granting Shell an Integrated Pollution Prevention and Control (IPPC) licence before undertaking an Environmental Impact Assessment. Shell to Sea have today sent in a submission to RTE as part of RTE’s public consultation on the updating of their Public Service Statement [1]. In the submission, Shell to Sea claimed that RTE had failed to inform the public in an honest and balanced manner on the Corrib Gas project.

In the submission nine examples of RTE bias over the course of the more than decade long community campaign against the Corrib Gas project were highlighted.

One of the examples given related to the so-called “Garda Rape tape” over which RTE were forced by the Broadcasting Authority of Ireland (BAI) to issue an apology, after a news item broadcast on July 28th 2011 was deemed by the BAI to be “inaccurate”, “unfair” and “harmful” to a Corrib campaigner. This related to Gardaí being inadvertently recorded joking about threatening to rape the two women who were in their custody. At the time of the incident the Garda Commissioner acknowleged the incident had happened and apologised for the incident occurring. Despite this RTE subsequently attempted to create the impression that the recording of the incident had been “altered” or “tampered with”. [2] read more

On 25 March 2015, I sent an email to the GSOC at the written invitation of Irish Justice Minister Ms Frances Fitzgerald T.D. supplying new evidence pertaining to the OSSL allegations against Shell E&P Ireland.  

It was in the form of an audio file and related transcript of a covertly recorded meeting between OSSL directors and their Dublin solicitor, Mr Marc Fitzgibbon. He suspected that the meeting was being recorded by OSSL, but said he was not concerned if it was. The alcohol was mentioned over 60 times in the recorded meeting. read more

The Irish satirical website broadsheet.ie has published an extensive article about Shell sponsored corruption in Ireland involving gifts (bribes) of up to €900,000 in value.  

The website has published two key items; an invoice sent to Shell E&P Ireland by its agent OSSL for £30,000 worth of alcohol supplied to named senior police officers and a transcript of a covertly recorded 42 minute meeting between OSSL and its Dublin solicitor when the alcohol was mentioned over 60 times.

The solicitor in question Mr Marc Fitzgibbon, attended multiple high level meetings with Shell when the supposedly non-existent alcohol was freely discussed. 

Shell has acknowledged receipt of the OSSL invoice raised years after the alcohol was supplied. It should be a simple matter for the police or tax authorities to investigate whether the invoice is legitimate. read more

The third successive year of a pre-AGM email bombardment of Shell by its former “Mr Fixit” company in Ireland, OSSL, is fully underway.

Several emails are sent every day by OSSL, not just to top executives at Shell, such as Ben van Beurden  but to the Irish Justice Minister and Senior Irish Police Officers.

The subject is always the same.

The alcohol purchased by OSSL on behalf of Shell, which OSSL distributed to senior Irish police officers on behalf of Shell. Police officers who took delivery are named in the emails. They were also named in a taxation invoice sent to Shell by OSSL for some £30,000 worth of police alcohol.  read more

Corrib Gas still set to flow this year, says Shell spokesperson

An 800 metre section of a water discharge pipe, which will carry treated surface water from the terminal at Bellanaboy in north Mayo 12 kilometres out to sea once the plant is opertional, had come loose from the seabed and was floating on the surface of Broadhaven Bay two weeks ago.

However, the problem has not had any impact on the target date to have gas flowing by the middle of this year.

A spokesperson for Shell E&P Ireland said the ducting has now been temporarily repositioned on the seabed and remediation work is ongoing to find a more permanent solution within the next few weeks. read more

Almost a kilometre of Corrib Shell pipeline loose and floating under sea

An 800m section of Shell pipeline from the Corrib gas processing plant has come loose and is floating under the sea.

Both Shell Ireland and Environmental Protection Agency (EPA) are investigating the incident off the north Mayo coast.

A Shell spokesperson said the pipeline was a piece of plastic ducting measuring 800m in length and carried treated surface water collected at the Bellanaboy terminal to around ten miles out to sea.

The ducting had been secured under heavy boulders and investigations will examine if bad weather in recent days contributed to it coming loose.

Marine vessels have been dispatched by Shell to investigate the matter. read more

It was only yesterday that I posted an article on the above subject after a long break in coverage.

The email from the justice ministry contains an apology for the delay in responding to a communication I sent to the minister several months ago. It related to the admittance by a Shell supplier OSSL, that it had for a long period distributed bribes to the Irish police, and other Irish parties, including land owners, at the express instruction of their client Shell EP Ireland. I reported the unusual circumstances in which OSSL was demanding payment from Shell to cover bribes paid on its behalf. read more

Shell gig invite turned down by The Saw Doctors

Folk rock band The Saw Doctors has turned down an invitation from Shell E&P Ireland to play at a gig in north Mayo this month celebrating the competion of the Corrib gas terminal.

The Tuam band, which is currently on a break from live appearances, said it was “not interested in playing for Shell E&P Ireland”.

However, Shell has confirmed that some musicians among the company’s own staff would be performing instead.

Band manager Ollie Jennings received the invitation from Shell several months ago, and confirmed this week that the musicians refused to accept the booking. read more

Royal Dutch Shell CEO Ben van Beurden has confirmed the company’s proposed Arrow LNG Project with PetroChina has been cancelled, but the Arrow Bowen Pipeline will not be affected.

Arrow Energy, which is jointly owned by Shell and PetroChina, had initially planned to develop a CSG to LNG processing facility on Curtis Island, Queensland. “We have slowed down on new developments which, for example, means Arrow greenfield LNG is off the table,” Mr van Beurden said.

However, work is continuing on the development of the Arrow CSG reserves in Queensland, which are now likely to be commercialised through a separate LNG project, with front-end engineering design (FEED) work progressing on the Arrow Bowen Pipeline. read more

Update on OSSL Shell Scandal

At the weekend I published an article under the headline: “Irish Police reopen and expand investigation into Shell corruption case?”

A question mark was placed at the end of the headline to denote a degree of uncertainty. 

This is my take on the actual situation according to information I have received today.

After pointing out that a recent Garda Ombudsman Commission (GSOC) investigation found no evidence of the alcohol supplied to Garda officers by OSSL on behalf of Shell and stating that the matter is closed, the Irish Justice Minister, Frances Fitzgerald, grudgingly invited OSSL to contact the GSOC with any evidence to support various related allegations. read more

Irish Police reopen and expand investigation into Shell corruption case?

According to an insider source, the Irish Police Garda Ombudsman Commission has reopened and expanded an investigation into evidence of corruption surrounding the Corrib Gas Project in Ireland.

I understand that this development was prompted by new evidence published on this website in relation to the whistleblower Irish company OSSL. Its directors have admitted distributing bribes on behalf of the Shell led project consortium.

This apparent development seems to be at odds with a statement issued by the Irish Justice Minister Frances Fitzgerald, in the Irish Parliament on 4 December 2014.

OSSL strenuously denies allegations that it has attempted to blackmail Shell and its project partners, Statoil and Vermilion. Shell has provided written proof that it has received hundreds of money demands from OSSL for the alcohol. read more
