OPPONENTS OF the Corrib gas project in north Mayo are seeking legal advice on a communication that indicates the Rossport solidarity camp is under 24-hour surveillance by a private security company.

The communication involves a “situation report” that documents movements at the protest camp in late June.

The solidarity camp, initially established at Rossport in 2005, is pitched on private land at Aughoose – one of two locations for the final part of the Corrib gas pipeline, along Sruwadaccon estuary, a special area of conservation. read more

Fine Gael leader Enda Kenny has called for an apology from fellow Mayo TD Dr Jerry Cowley (Ind) about a picket of his constituency office over the Corrib gas issue.

Mr Kenny says he holds Dr Cowley “personally responsible” for “the behaviour, attitude and abusive language” towards two of his staff during an eight-hour protest on Friday in Castlebar.

Mr Kenny says he was “compelled for the safety and security” of his office and staff to call the gardaI to remove Dr Cowley “and his supporters” late on Friday. read more

HUMAN RIGHTS group Action from Ireland (Afri) has criticised both the Garda Síochána and Shell over “the bungled transport” of a huge tunnelling machine.

As reported widely, a 170-tonne lorry transporting the Shell machine to bore the sub-sea tunnel linking raw gas to an inland refinery, jack-knifed at a narrow crossroad in Glenamoy, Co Mayo, last Tuesday morning.

The lorry cut off local traffic for a time, including people travelling to Castlebar for hospital appointments. Mayo County Council and Shell workers finally removed the lorry on Friday afternoon, after it widened the roadway. This operation, which involved a convoy of lorries transporting materials for the remedial works, was facilitated by more than 100 gardaí in the early hours of Friday morning. read more

In its anxiety to develop the gas field, Shell overstepped its authority and undertook work that was not specifically sanctioned by Minister for Communications, Marine and Natural Resources Noel Dempsey. It is now days since five men went to jail for refusing to give an undertaking that they would not obstruct work on the construction of the Corrib gas pipeline in North Mayo. They have been in court on a number of occasions since that time. And, in spite of an invitation from High Court president, Mr Justice Finnegan, to purge their contempt and his observation that there was no sense in their remaining in jail, they have continued to opt for incarceration.

High stakes are being played for here. When the protests began some months ago, the great majority of local people had come to accept – after years of controversy and public debate – that the processing of natural gas from the Corrib field would take place on shore. The jailing of the men, following legal action by Shell E&P Ireland, has changed that situation. read more

A giant tunnel boring machine belonging to Shell, which became stuck on Tuesday after the lorry it was being transported on jack-knifed at an isolated Co Mayo crossroads, has been removed.

A spokesman for Mayo County Council said the junction at Glenamoy crossroads near the villages of Rossport and Carrowteigue was now cleared and that traffic was back to normal.
In a statement Shell E&P Ireland said it “apologises once again to the local community and to all road users who were inconvenienced by this incident”. read more

Heavy vehicles deployed to shift lorry

More than 100 gardaí escorted a convoy of heavy vehicles to the isolated Glenamoy crossroads in north Mayo at about 4.30am this morning in a bid to free Shell’s giant tunnel boring machine.

A spokesman for Rossport Solidarity Camp said the gardaí implemented checkpoints from about 10km away at Bangor Erris.

He confirmed that veteran campaigner, Maura Harrington, was arrested at one of the checkpoints, and that the rear window of her van smashed when she declined to exit it. The van was subsequently impounded and Ms Harrington was detained at Belmullet  Garda station. read more

Shell’s giant tunnel boring machine is expected to remain at an isolated Co Mayo crossroads for a third night, as residents questioned the ability of the boggy road to withstand the weight of heavy removal vehicles and some protestors vowed to continue their actions.

A Mayo County Council spokesman confirmed the local authority was continuing to work with oil company experts and hoped the machine and jack-knifed lorry would be removed within the next two days.

“It is envisaged that the problem will be resolved in the next 24 to 48 hours but that is contingent on the level of protest activity encountered. The protestors have already delayed the transportation of lifting equipment to the scene,” the council spokesman said. read more

Efforts to move a jack-knifed 160-ton truck carrying machinery for a controversial gas project are farcical, campaigners have claimed.

As the 40m vehicle continues to block a road in Co Mayo, protesters against Shell’s Corrib scheme said it will take a miracle to move it.

One of the Rossport Five, Willie Corduff, was arrested earlier today during protests over traffic disruption since the truck got stuck near the Glenamoy Bridge in Erris yesterday morning.

Mr Corduff was one of five men who spent 94 days in jail in 2005 after refusing to agree not to protest against the project. read more

The five Mayo men who return to the High Court today over their opposition to the Corrib gas onshore pipeline have accused the Minister for the Marine of using mediation as a “ploy”.

Three weeks after their release from jail, the men told a press conference in Castlebar, Co Mayo, yesterday that neither Noel Dempsey nor his officials had made any contact with them in relation to proposed mediation.

The president of the High Court yesterday declared he was satisfied Shell had carried out no unauthorised works on lands owned by some of the Rossport Five, who were jailed for breach of court orders made after they objected to works linked to the installation of the high-pressure Corrib gas pipeline.

However, the issue of whether there were unauthorised works by Shell relating to the laying and welding of pipes on other lands was a matter between the company and the Minister for the Marine, Mr Justice Joseph Finnegan said. This issue was not one before the court. read more

Minister for the Marine Noel Dempsey says he will “consider” a call by some north Mayo residents for a deferral of his dismantling order for the illegally welded section of the Shell onshore gas pipeline.

The Minister was responding to a statement issued by the Pro-Erris Gas Group (PEGG) yesterday, in which it proposed the dismantling be postponed until the Minister’s new safety review is published.

The group said that if the safety review endorsed the onshore pipeline, Shell should be fined a minimum of 250,000 instead. This money should be used “exclusively” on “worthwhile projects” within the Kilcommon parish, the group said in the statement, issued by its chairman, Michael Healy. read more

If the law is inappropriate or inadequate then it should be changed, but until it is changed it must be upheld.

I should make it clear that during the course of their imprisonment, my concern was to make constructive proposals to the Government, Shell and the men themselves that might lead to their release. read more

Madam, – There have been many unsung heroes (and heroines) in the protracted dispute over the proposed gas terminal at Rossport, Co Mayo. I would like to draw attention to one rarely mentioned group, namely the people from all over Ireland and further afield who have staffed the protest camp which is situated right on the route of the proposed high-pressure gas pipeline at Rossport,

This camp, which is in the middle of an old turf bog, and which has been occupied round the clock since August even though it is gradually sinking into the aforementioned bog, is due to he dismantled later this week owing to the hardships and difficulties in trying to continue occupying it in the face of Atlantic gales and storms. The protesters intend to return in the spring. In the meantime a presence will be maintained in the area to keep an eye on things and to monitor any breaches of the “ceasefire” which may be perpetrated by Shell or the State. read more

The five men from Rossport in Co Mayo who spent 94 days in prison for being in contempt of the High Court received a warm welcome home at the weekend and are no doubt happy beyond words to be back with their families and friends.

It would be churlish not to wish them well but as they themselves have noted since their release on Friday, the saga that landed them in jail is far from over.

A Government-ordered safety review, in which opponents of the gas pipeline have refused to participate, could reach conclusions that neither side find comfortable. Separately, a mediator is to be appointed under the plan brokered by marine minister Noel Dempsey. That person will need to command the respect of both sides and will need to have terms of reference acceptable to both for their appointment to get off the ground. Thereafter, there must then be real and tangible evidence of good will for the mediation process to reach a successful conclusion. read more

The five Mayo men who spent 94 days in prison over their opposition to the Corrib gas onshore pipeline have insisted that the Government must participate in mediation talks.

Minister for the Marine Noel Dempsey intends to seek an agreed nominee over the coming week to chair the discussions between Shell E&P Ireland and the five men and their community, but the group believes the Minister should be represented.

“The State cannot remain neutral in this,” the five men – Micheal O Seighin, Vincent and Philip McGrath, Brendan Philbin and Willie Corduff, told The Irish Times at the weekend. Shell E&P Ireland has denied fears of losing ministerial consents for the 900 million gas project if it lifts the injunction against five Mayo men in prison over opposition to the onshore gas pipeline.

However, the company has issued a plea to the men in prison to “consider their position”, following its first formal offer to them this week of mediation without any preconditions.

The men have agreed to formal mediation, but their solicitor, Padraic Ferry, said yesterday this could only take place if the injunction was lifted, as otherwise the men would be under duress. read more

Extra gardaI were called to the Shell/Corrib Bellanaboy terminal site in Co Mayo yesterday when protesters refused to allow Shell company representatives to leave the compound.

Four company representatives had entered the site at about 5am yesterday before the Shell to Sea picket began at 6am.

The company confirmed that the representatives entered “early yesterday” to carry out essential environmental works which had been requested by Mayo County Council. The four had left the site by yesterday evening, the spokesman said. The jeep used by the four was still parked outside the terminal as pickets continued last night. read more

Fianna Fail’s Noel O’Flynn, chair of the Oireachtas Committee on Communications, Marine and Natural Resources, rejected a Labour Party claim that he is avoiding convening a meeting on the Shell Corrib gas issue.

Mr O’Flynn was responding yesterday to criticism of him by one of the Oireachtas committee members, Labour TD Tommy Broughan, who has accused him of “running away” from the issue.

The five Co Mayo men, who have been in prison for 71 days for contempt of court relating to the Shell Corrib gas pipeline, made a brief appearance in the High Court yesterday.

Although nothing of legal significance took place in court yesterday, the men were permitted to meet with family members and friends in the time between the two-minute hearing and their return to jail.

During their two-hour stay in the courts complex, the five men mixed with relatives in the Round Hall of the Four Courts before being taken back to their cells in a prison bus to Cloverhill Prison. read more

Mayo TD Dr Jerry Cowley (Ind) has accused Taoiseach Bertie Ahern of “missing the point” over the continued imprisonment of the five Mayo men opposed to the Corrib gas onshore pipeline.

Dr Cowley, who is one of a delegation of Independent TDs meeting the Norwegian ambassador to Ireland today over the issue, said he was disappointed at remarks made by the Taoiseach in Ennis, Co Clare, at the weekend.

The 13-9 vote followed strong legal advice from the council’s lawyer, Michael Browne, that the motion, if passed, could expose the authority to expensive litigation.

Minister for the Marine Noel Dempsey promised to involve the Health and Safety Authority, An Bord Pleanala and the Environmental Protection Agency in reviewing Shell’s safety audit of the Corrib gas field project before issuing final consent.

Madam, – The new safety review of the proposed Corrib Gas pipeline announced recently by Noel Dempsey poses an interesting dilemma for the pipelines’ opponents.

There is at least a possibility that this report will conclude that the pipeline’s risks to public health are very low. Rather than focus on the lack of impartiality of earlier risk assessments, I think it is important to move to a less ambiguous stance, namely that this pipeline and onshore terminal, as currently proposed, should not go ahead in any circumstances. Quite apart from the environmental degradation and the social impact on the area, an onshore terminal is totally unnecessary. read more

Fine Gael leader Enda Kenny has called for an apology from fellow Mayo TD Dr Jerry Cowley (Ind) about a picket of his constituency office over the Corrib gas issue.

Mr Kenny says he holds Dr Cowley “personally responsible” for “the behaviour, attitude and abusive language” towards two of his staff during an eight-hour protest on Friday in Castlebar.

Mr Kenny says he was “compelled for the safety and security” of his office and staff to call the gardaI to remove Dr Cowley “and his supporters” late on Friday. read more

Business Opinion: The dispute between Shell and the residents of north Mayo spilled over into the British papers last week.

With the clarity that observing something from a distance allows, the story was distilled down to the company being ordered by the Irish Government to dismantle a pipeline because it had been built illegally.

The other key fact to be gleaned from the UK newspaper reports was that five local men are in jail in Ireland for opposing this apparently illegally built pipeline, the safety of which appears to be an issue, because the Government is ordering an independent inquiry. read more
