ShellNews.net: constructive offer to Shell in relation to its defamation lawsuit

EMAIL SENT TODAY TO MR. ERIC SIOW, THE LAWYER ACTING FOR SHELL WHISTLEBLOWER DR JOHN HUONG IN THE DEFAMATION ACTION BROUGHT AGAINST HIM COLLECTIVELY BY EIGHT COMPANIES WITHIN THE ROYAL DUTCH SHELL GROUP

EXTRACT: Of course the best solution of all would be for Shell management to stop using the unfortunate Dr Huong as a surrogate for attacking our activities and instead take legal action directly against us in the appropriate legal jurisdiction. Shell management self-evidently does not have the courage to take that step.  Shell would sue us for defamation if our allegations and comments were without foundation.  There is no defamation if what is being published is true. The fact that Shell management is taking a hammering almost every day on our websites, without returning fire, speaks volumes.

THE EMAIL

Dear Mr. Siow

I have explained in my email of 6 August why my father, Alfred Donovan, is physically unable to travel any distance in connection with Shell’s application for him to be cross-examined in the contempt proceedings arising from Shell’s defamation case against Dr John Huong.  My father can still write candid articles about Shell (he thoroughly enjoys doing so) but he is too frail to undertake anything other than local travel.

I have under the circumstances offered myself up for cross-examination in his stead. I wondered in this connection if it would be possible to arrange for me to give testimony and be cross-examined in the Malaysian High Commission in London? The evidence would then be given within Malaysian legal jurisdiction. Shell has hundreds of lawyers based in London, anyone of whom could represent the EIGHT Royal Dutch Shell plaintiff companies. If this was possible, then there would be NO cost to Shell for my expenses, as I would not require flights, hotel, or legal representation.

Of course the best solution of all would be for Shell management to stop using the unfortunate Dr Huong as a surrogate for attacking our activities and instead take legal action directly against us in the appropriate legal jurisdiction. Shell management self-evidently does not have the courage to take that step.  Shell would sue us for defamation if our allegations and comments were without foundation.  There is no defamation if what is being published is true. The fact that Shell management is taking a hammering almost every day on our websites, without returning fire, speaks volumes.

It prefers to terrorise an unemployed former Shell employee of 29 years standing who made the mistake of putting his faith in Shell management pledges to uphold the core principles of the Shell Statement of General Business Principles.

Please convey this offer to Shell’s solicitors if it has any merit.

Regards
John Donovan
