An Italian court has ruled that oil giants Royal Dutch Shell PLC and Eni SPA are not guilty in a bribery case involving a Nigerian oilfield that has spanned years, according to the Wall Street Journal.

Shell, Eni, and Eni’s CEO Claudio Descalzi, have been on trial for years in the infamous OPL 245 case. Shell, Eni, Descalzi, and others, were accused of knowing that more than $1.1 billion of the $1.3 billion deposited a decade ago into an escrow account controlled by the Nigerian government would eventually be used as bribes to secure oil drilling rights. read more

Shell and Eni to Be Tried Over $1.3 Billion Nigerian Oil Deal

LONDON — An Italian judge ruled on Wednesday that two of the world’s largest oil companies, Royal Dutch Shell and Eni, the Italian company, must go on trial on charges of corruption over a $1.3 billion oil deal in Nigeria.

The judge set a March 5 trial date in Milan for the companies as well as a group of current and former executives, including Claudio Descalzi, Eni’s chief executive, and Malcolm Brinded, a former chief of exploration and production for Shell. No current Shell officials were to be tried in the case. read more

Italian oil giant Eni in a public filing this month revealed further details about what corruption allegations and investigations its facing around the world.

Corruption allegations against Eni now include Nigeria, Iraq, Kazakhstan, Algeria, and Congo. The number of enforcement authorities, employees, and subsidiaries involved in these allegations has also grown.

NNPC holds 49% equity in NLNG on behalf of the Nigerian government, with partners Shell (25.6%), Total (15%) and ENI (10.4%.)

State-owned Nigerian National Petroleum Corporation has not remitted $11.6 billion in dividends and loan and interest repayments earned from exports from the Bonny LNG plant from 1999-2012, the country’s oil industry auditors said late Tuesday.

NNPC could not immediately be reached for comment Wednesday.

The Nigerian Extractive Industry Transparency Initiative, or NEITI, said in a statement that the earnings represent NNPC’s share of 49% equity ownership in Nigeria LNG Ltd., owner of the six-train, 22 million mt/year Bonny LNG plant. read more

Nigeria’s Naira firmed 1.13 percent against the dollar on the interbank market in thin trade on Monday, supported by dollar flows from two energy companies, traders said.

The naira closed at 199.7 to the dollar compared with 202 on the interbank market on Friday, dealers said.

The central bank had set its intervention rate at 196.8/197.8 to the dollar on Monday, but dealers said the regulator had not yet sold dollars to lenders by 1302 GMT.

The Nigerian unit of Royal Dutch Shell sold an undisclosed amount of dollars while Eni sold $15 million, lending support to the naira, traders said. read more

The fund arose from the sale of one of Nigeria’s largest offshore oil concessions, known as OPL 245 to subsidiaries of oil multinationals, Royal Dutch Shell and ENI.

Eni payments ‘used to bribe Nigeria officials’

Where are the Dutch police, Interpol and Europol in this affair? Where is the SEC, and the authority that enforces the FCPA? It is simply not enough to say that Shell is “not under investigation”.

I don’t know if you saw yesterday’s article (below) in Upstream about the Nigerian OPL245 case, but it seems that a large number of the Malabu payments have been traced.

If the article is to be believed (and Upstream is usually quite good) it appears that Shell was unaware of the payments being made on behalf of their joint venture with ENI. If they really did not know that these payments were being made, Shell were not acting in the interests of their shareholders – it is hard to believe that Shell really agreed to pay their share of $600 million out of a total of $1.2 billion without investigating where the funds were going. read more

In the Economist article from last year – Safe sex in Nigeria – the numbers simply do not add up. The explanation given is that “others” had benefited from the proceeds of the OPL 245 sale to Shell and Eni.

The obvious conclusion is that these would have been people directly connected to the Nigerian government and Etete.

One possible conclusion that is not discussed is that people within ENI and/or Shell may also have benefited during the distribution of the funds. It would not be the first time that “conflicts of interest” had arisen in Shell and ENI. read more

Kashagan Appoints Exxon Executive To Run Troubled Oil Venture

ALMATY, June 6 (Reuters) – The troubled Kashagan oil development has named an executive from U.S. firm Exxon Mobil to run the venture while also streamlining its complicated structure in an attempt to fix the beleaguered $50 billion project offshore Kazakhstan. The group said on Friday Stephane de Mahieu, an Exxon secondee, had become managing director as of May 1, 2014. However, it denied a report in industry publication Nefte Compass that Exxon would take over as operator of Kashagan saying that instead all seven oil firms involved will be effectively operators through a rejigged venture. read more

Kashagan ‘Cash All Gone’ Pipeline Debacle

Shell has been a key participant in the Kashagan project consortium which includes Eni and ExxonMobil. Given its notorious track record of over-promise and under delivery, having Shell involved is a bad omen for any elephant project.

The latest news from the “Cash All Gone” project (as it is widely known) is that due to the need to replace fatally flawed leaking pipelines, the oilfield may not restart until 2016. 

The project is already years behind schedule and countless billions over budget.

I have received some related comment and questions from a retired Royal Dutch Shell EP expert that deserve to be put into the public domain.

Lack of new disclosure rules for foreign government access puts investors at risk

Conspicuously missing from the Securities and Exchange Commission’s annual update on regulatory activity released last week is a rule requiring companies to disclose what they pay foreign governments for access to natural resources. The agency needs to put an immediate end to these secret payments if it is to do its job of protecting investors.

New information suggests that the US$1.1 billion paid by Shell and the Italian energy company ENI for a Nigerian oil block could fall foul of anti-corruption legislation and highlights the urgent need for strong disclosure laws across the EU. A directive being discussed by the EU Council and Parliament must require full “project-by-project” disclosure to ensure such payments are publicly reported.

The payments made by Shell and ENI in 2011 relate to a disputed Nigerian oil block, OPL-245.[i] Though Shell and ENI paid the Nigerian government, funds were then transferred shortly after to a company controlled by ex-Oil Minister, Dan Etete, who in 2007 was convicted in France of money laundering. According to the current Nigerian Attorney General and Minister of Justice, Mr Mohammed Adoke, Shell and ENI were fully aware and in agreement that the money would then be transferred to Etete’s company, Malabu Oil & Gas. Earlier this year he stated, “SNUD [a subsidiary of Shell] and ENI agreed to pay Malabu through the Federal Government acting as an obligor the sum of US$1,092,040,000…”[ii] Malabu first obtained the oil block in 1998, in controversial circumstances when Etete himself was the Nigerian Oil Minister under the country’s then-leader General Abacha. read more

As a concerned Nigerian, I urge the House Committee on Upstream Petroleum, to investigate the approval of the above Oil license and sale to Shell & Agip by DPR and the Ministry of Petroleum; and consider the transfer of ownership to Shell and Agip as illegal; in addition to revert the said oil block to its previous status and only allow such oil block to be sold to parties who fit the requirement of the oil blocks initial license. Dec 7 (Reuters) – Royal Dutch Shell and Eni have bought the prospective Nigerian deep offshore oil block OPL 245, Shell said on Wednesday, ending a decade of legal disputes over the huge asset.

A spokesman for the Anglo-Dutch major said it would own 50 percent of the block with Eni owning the other half and operating output.
