For the record, the litigation news reports in the “Motiva Live News Feed” – eg. Nintendo Stomps Motiva’s Patent Infringement Claims relate to a small company called Motiva LLC, not Motiva Enterprises, the company owned jointly by Shell and the Saudi regime.

The apparent clash prompted memories of the time that we approached Nintendo and Shell proposing a Nintendo themed instant win promotional game for Shell forecourts. We went to the trouble of obtaining approval from Nintendo before disclosing our proposal to a Shell executive, AJL, on a strictly confidential basis.

As we are approaching the 20th anniversary of our spectacular falling out with Shell, involving Six High Court cases, a County Court action and unsuccessful proceedings issued by Shell via The World Intellectual Property Organisation, I have been looking at some of the past correspondence in connection with articles we intend to publish.

The trial took place before Mr Justice Laddie who failed to declare two potential conflicts of interest. A connection with the barrister son of the Royal Dutch Shell Group Managing Director, Mark Moody-Stuart and a long friendship with Mr Tony Willoughby  who founded an IP firm which had Shell as a client. This information was unknown to the Plaintiff and his father Alfred Donovan, against whom Shell had filed a Counterclaim also being heard by Mr Justice Laddie as part of the same trial.
