Kiobel v. Royal Dutch Shell litigation

Posted on January 13th, 2017 by Sarah A. Altschuller

The name Kiobel is familiar to many who follow litigation regarding human rights in the United States. Esther Kiobel was a plaintiff in the Kiobel v. Royal Dutch Petroleum litigation that led to the 2013 Supreme Court decision which established that the presumption against extraterritoriality applies in cases brought pursuant to the Alien Tort Statute.

Ms. Kiobel is back in U.S. court, this time pursuing access to documents held by Cravath, Swaine, & Moore LLP, which represented Royal Dutch Shell in the earlier litigation. read more

Nova Scotia offshore oil and gas ‘doesn’t look good’ after Shell seals 2 wells

By Michael Tutton, The Canadian Press Posted: Jan 18, 2017 5:12 PM

Shell’s decision to seal two exploration wells off Nova Scotia has set back the province’s dream of offshore riches, but analysts say it’s early days in what may prove to be a complex geological hunt.

Wade Locke, a resource economist at Memorial University says Shell’s confirmation this week it’s abandoning the Monterey Jack well, along with news its Cheshire deepwater well did not have commercial quantities of oil, are not confidence boosters. read more

Toyota Motor Corp. and four of its biggest car-making peers are joining oil and gas giants including Royal Dutch Shell Plc and Total SA with plans to invest a combined 10 billion euros ($10.7 billion) in hydrogen-related products within five years.

In all, 13 energy, transport and industrial companies are forming a hydrogen council to consult with policy makers and highlight its benefits to the public as the world seeks to switch from dirtier energy sources, according to a joint statement issued from Davos, Switzerland. Computer glitch leaves 900 Shell stations unable to dispense fuel

BY EDDIE CHUA: Monday 16 Jan 2017

PETALING JAYA: A computer glitch at Shell Malaysia’s centralised monitoring system crippled the operation of 900 of its petrol stations nationwide Monday as motorists were unable to fill up their tanks.

The glitch started at midnight resulting in the petrol pumps, which are linked to the system, to stop dispensing fuel.

Only petrol stations with the older version of the pumps, which are not linked directly to the system, were able to dispense the fuel. However, only a handful of the stations has such older machines. read more

Opec outflanked

By Ed Crooks of the Finacial Times: January 13, 2017

In the 1930s many newspapers carried impressively detailed diagrams showing France’s defences along the German border, described by Popular Mechanix and Inventions magazine as the “world’s greatest underground fortifications”. By the end of May 1940, Hitler had demonstrated that while the Maginot Line might indeed be an engineering marvel, it was also irrelevant, as his panzer divisions swept past it through Belgium and into France. Last year’s agreement between leading oil-producing countries to curb their output had something of the same feel about it this week. read more

Shell oil workers in Gabon begin “unlimited” strike on Thursday

Royal Dutch Shell workers in Gabon began an “unlimited” strike on Thursday at all the company’s operations in the Central African OPEC member country, the workers’ union wrote in a letter to employees.

Shell is in advanced talks to sell its Gabon assets, which one source estimated could be worth $700 million, leaving workers worried about layoffs or being moved to new locations, the union said.

The national union of petroleum employees (ONEP) said the strike “will cover all of Shell Gabon’s operations (Libreville, Port-Gentil, Gamba Rabi, Koula and Toucan)”. read more

Widow of executed activist wins access to documents in claims against Shell

Written by Reporter – 12/01/2017 3:31 pm

The widow of an activist executed after protesting against oil major Shell’s oil production in Nigeria has won access to legal documents.

They will be used in a legal case for damages against the oil giant which Esther Kiobel plans to pursue in the Netherlands.

It comes after a US judge told Shell’s US lawyers to handover the documents about Shell’s activities in Africa.

Kiobel has alleged Shell was complicit in the execution of her late husband, alongside author and environmental activist Ken Saro-Wiwa, by the Nigerian military in 1995 because it provided support and funding for the army in its crackdown of opposition to a Shell-led joint venture in the Niger Delta. read more

Brent clear-up to test ‘leave no trace’ obligation

Shell battles Nigerian communities in high-stakes London lawsuit

By Karolin Schaps and Libby George | LONDON

A court in London will decide in coming weeks whether Royal Dutch Shell can face trial in the UK over oil spill allegations in Nigeria, a decision some legal experts predict could attract more cases against multinationals in Britain.

The High Court will judge whether members from two communities, Bille and Ogale in Nigeria’s oil-rich Delta region, can sue the Anglo-Dutch company in British courts.

The communities say Nigerian courts are unfit to hear the case against Shell subsidiary Shell Petroleum Development Company of Nigeria (SPDC). Shell says the case should be heard in Nigeria because the matter is “uniquely a Nigerian problem”. read more

Royal Dutch Shell plc: Employees Speak Up

Oil Prices

Extracts from a weekly briefing by Ed Crooks: January 6, 2017

In our predictions for 2016, we were right that oil would end the year over $50 – modesty forbids me from mentioning which writer made that forecast – but missed that an agreement between Opec and non-Opec producers would be one of the factors underpinning the price. For 2017 Anjli Raval made the call, arguing that crude was again likely to end the year above $50, on the grounds that a lower price would still be too low to enable sufficient investment in production to meet demand. read more

Dutch court upholds Groningen gas production cap

Jan. 5, 2017 2:28 PM ET|By: Carl Surran, SA News Editor

A Dutch court today upheld a government decision to cap production at the Groningen gas field at 24B cm until Oct. 1, 2021, a step aimed at easing the risk of earthquakes triggered by drawing gas from the field.

The court was responding to requests for a preliminary injunction against the June decision, opposed by groups who sought a halt or a deeper cut to production at Groningen.

Output has been cut several times from 53.9B cm in 2013 amid criticism that Dutch authorities had failed to adequately assess the risk to citizens from earthquakes caused by gas production. read more

Royal Dutch Shell Better Positioned as Oil-Producing Countries Begin to Reduce Output

January 04, 2017, 10:32:39 AM EDT By MT Newswires

Royal Dutch Shell (RDS.A, RDS.B) is in a better position as members of the Organization of the Petroleum Exporting Countries and other producers begin curbing production in a bid to boost prices, RBC researchers said in a note to clients on Wednesday.

“We believe the recent OPEC/non-OPEC supply deals have put the oil market on much firmer footing, which removes some of our tail-risk concerns for Shell,” the analysts said. “Looking ahead, we see the potential for strongly improving cash flow generation, while in the near term, we believe net debt should begin falling from its peak.” read more

Oil Major Shell Plans To Shrink As Oil Rebounds

By Nick Cunningham – Jan 03, 2017, 3:07 PM CST

Oil prices are rising and the industry is poised for a rebound, with U.S. shale spending set to soar in 2017. But for Royal Dutch Shell, this year will be much more mundane as years of high spending and ballooning deficits force the Anglo-Dutch oil major to retrench.

Even as the New Year promises to bring a sharp improvement in the finances of oil companies across the world, including Shell, not everyone will approach the rebound in the oil market in the same way. Smaller U.S. shale companies, with assets concentrated in some highly profitable areas such as the Permian, are planning to sharply increase spending and drilling. But the oil majors are less nimble, having assets diversified upstream and downstream, spread out across the globe. They were able to weather the oil price downturn better than their smaller peers, but they respond much more slowly to fluctuations in the oil market. That stability is a feature for many investors looking to avoid volatility, but it also means that 2017 may not bring much excitement from the majors. read more

It comes as little surprise that Royal Dutch Shell (LSE: RDSB) has rocketed during the fourth quarter, the stock reaching 13-month peaks just last week on the back of the successful OPEC production accord. Shell gained 18% in total during October-December.

The Doha deal has been heralded as a game-changer in addressing the supply/demand imbalance washing over the oil market. And with no little reason. After all, OPEC is responsible for around 40% of global crude output. read more
