Donovan Verdict on Shell/Noble Arctic Crimes

People who are as familiar with Shell as I am, will know that Noble Drilling has stepped forward on commercial grounds to take the blame for the reckless screw-up that was actually directed by Shell, partly to evade tax.

This was why Lawrence of Alaska (David Lawrence, the Shell VP supposedly responsible for Shell’s Arctic shambles) was fired at the time. He was himself a fall guy for his boss, Marvin Odum, the President of Shell Oil Company.

Noble Drilling obviously wants to keep Shell as a client and has therefore been willing to soak up the  criminal record, with attendant reputational fallout and multimillion dollar fines. read more

Greenpeace Verdict On Shell/Noble Arctic Crimes

“Shell has proven time and again it can’t be trusted to manage its contractors safely. That Shell engaged Noble Drilling, a company now guilty of eight felonies, is the clearest indicator yet. Letting Shell back into such a precious and risky environment as the Arctic would be sheer madness, yet that’s what Shell wants to do next summer. Surely now President Obama has to think twice about approving Shell’s next venture in the Arctic, which the government’s own scientists say has a 75% chance of causing a large spill. read more

Drilling Company Charged with Environmental and Maritime Crimes in Alaska

Noble Drilling (U.S.) LLC was charged with environmental and maritime crimes for operating the drill ship Noble Discoverer and the drilling unit Kulluk in violation of federal law in Alaska in 2012, the Department of Justice announced.

Under the terms of a plea agreement filed in federal court today, Noble will plead guilty to eight felony offenses, pay $12.2 million dollars in fines and community service payments, implement a comprehensive Environmental Compliance Plan, and will be placed on probation for four years. In addition, Noble’s parent corporation, Noble Corporation plc, headquartered in London, England, will implement an Environmental Management System for all Mobile Offshore Drilling Units (MODUs) owned or operated by Noble Corporation plc and its direct and indirect subsidiaries worldwide. read more

BP loses latest US oil spill appeal

BBC News article published 8 December 2014: BP loses latest US oil spill appeal

The US Supreme Court has rejected oil giant BP’s legal challenge to a compensation deal over the 2010 Gulf of Mexico oil spill.

It means BP will have to make the payments that stem from the explosion of the Deepwater Horizon oil rig.

BP argued that the deal meant it could fall prey to inflated or bogus compensation claims.

BP agreed to the compensation deal in 2012, but argues it has been misinterpreted.

Shares in BP fell 1.7% in London on Monday.

BP asked the Supreme Court to consider whether people and businesses seeking payments under the settlement included individuals who had not actually suffered any injury as a result of the oil spill. read more

A Shell/BP tie-up would have to be financed by Shell equity, and is unclear why BP shareholders would want to hold Shell stock right now, unless a big premium were offered. Regulatory hurdles won’t be easy to overcome, which heightens execution risk. ACCRA, GHANA—A recent oil spill in Nigeria sent about 3,800 barrels gushing out of a pipeline and into the swamps of the oil-producing Niger Delta. Royal Dutch Shell, whose Nigerian subsidiary manages the ruptured pipeline, says the spill was caused by oil theft, which is a chronic problem for oil producers in Nigeria.

Local communities blame Shell for some of the spills that have fouled the Delta. The people of Bodo, a community that suffered two spills in 2008, are suing the company in a London court. In November, Amnesty International released court documents that it said showed Shell knew its pipeline at Bodo was shoddy. Shell denies the claim. read more

The United States District Court for the District of Oregon recently denied a motion to dismiss a putative nationwide class action brought against Shell Oil for alleged breach of contract, false advertising and an array of state consumer protection allegations.

In the action captioned Kearney v. Equilon Enterprises, LLC d/b/a Shell Oil Products US, 14CV254, Shell Oil moved to dismiss the putative class action complaint. While the court dismissed several state law statutory claims, the court refused to dismiss plaintiffs’ nationwide breach of contract claim. read more

One major oil giant that is optimistic about future projects in Mexico is Royal Dutch Shell plc. (ADR) (NYSE:RDS.A). Shell has been involved in oil exploration and production on the US side of the Gulf of Mexico for over 30 years and is among the top producers there. Update on OSSL Shell Scandal

At the weekend I published an article under the headline: “Irish Police reopen and expand investigation into Shell corruption case?”

A question mark was placed at the end of the headline to denote a degree of uncertainty. 

This is my take on the actual situation according to information I have received today.

After pointing out that a recent Garda Ombudsman Commission (GSOC) investigation found no evidence of the alcohol supplied to Garda officers by OSSL on behalf of Shell and stating that the matter is closed, the Irish Justice Minister, Frances Fitzgerald, grudgingly invited OSSL to contact the GSOC with any evidence to support various related allegations. read more

Decade-old oil spills from tanks at the Shell Oil facility in Fredericia are still polluting the environment.

According to a report on the DR current affairs TV program ’21 Søndags’, tonnes of diesel and kerosene have flowed out of the tanks for years and are now polluting the soil and groundwater in the area and flowing into the Little Belt.

“I would say that a very, very strong oil spill has spread out below the beach and seeped beneath the Little Belt into the water,” Thomas Steen Petersen, an engineer and soil expert at Kogsgaard Environment, told DR. “We must assume it has been going on for two or three decades. I have never seen anything like this before.” read more

SHELL DEFAMATION CASE HAS PROFOUND IMPLICATIONS

In 2009, Shell Oil Co. was facing allegations of international bribery in Nigeria. It told federal prosecutors that one of its employees approved and facilitated the bribes and then lied about his role to company lawyers. In 2010, the case took an unexpected turn. The employee, senior petroleum engineer Robert Writt, sued for defamation. He claimed that the energy giant’s allegations were lies that slandered his good reputation.

Shell has attracted a huge amount of unwelcome attention to its company culture of  corruption as a result of making defamatory comments about a former employee, Robert Writt. Basically it ruthlessly tried to make him a  scapegoat.

Mr Writt contacted my late father, Alfred Donovan, in August 2009. Many people, including former Shell employees mistreated by Shell, make contact with us.

Shell destroyed his reputation in an attempt to cover-up the truth and minimise financial consequences to Shell. A penalty imposed on Shell was cut by half, from $60 million to $30 million. read more

Irish Police reopen and expand investigation into Shell corruption case?

According to an insider source, the Irish Police Garda Ombudsman Commission has reopened and expanded an investigation into evidence of corruption surrounding the Corrib Gas Project in Ireland.

I understand that this development was prompted by new evidence published on this website in relation to the whistleblower Irish company OSSL. Its directors have admitted distributing bribes on behalf of the Shell led project consortium.

This apparent development seems to be at odds with a statement issued by the Irish Justice Minister Frances Fitzgerald, in the Irish Parliament on 4 December 2014.

OSSL strenuously denies allegations that it has attempted to blackmail Shell and its project partners, Statoil and Vermilion. Shell has provided written proof that it has received hundreds of money demands from OSSL for the alcohol. read more

Shell Rethinks $90M Toxic Contamination Settlement Over Secrecy Issues

Just days ago, we re-published an article from The Daily Breeze about Shell’s $90 million settlement with nearly 1500 residents of Carson, California, arising from a contamination class action lawsuit stemming from a former Shell oil tank farm.

A housing development was built over the remains of the buried tank farm in the 1960s.

Widespread petroleum contamination was subsequently discovered beneath hundreds of the homes in 2008 and residents sought compensation for decades of poor health and declining home values due to the contamination. They claimed they and their pets had been made seriously ill with ailments such as cancer, blood disorders and many other conditions. read more

Wanted: Shell Senior Legal Counsel to evade Anti Bribery and Corruption laws?

Just spotted an advert for the job of Senior Legal Counsel for Anti Bribery and Corruption at Royal Dutch Shell Group.

Apparently part of the job function is to provide specialist advice in connection with the Shell Anti-Corruption Manual, which probably has the same standing within the company as the outdated Shell Business Principles – just a theatrical prop designed to conjure up an illusion of honesty.

Shell BP: Return of the megamerger?

Price crashes in the early 1980s and late 1990s sparked a rash of deal-making that reshaped the industry. A decline in the mid-2000s led the giant firms to pick up smaller companies. Now, with oil’s price down 40% since June, bankers and investors are hoping for a repeat.

Traders are betting on it: BP PLC shares jumped by close to 5% Tuesday after an anonymous Twitter user claimed rival Royal Dutch Shell PLC was going to make a bid. Spokesmen for BP and Shell declined to comment. read more

Danger to Shell from Class Action Lawsuits Arising from Bribery

Two articles have just been published about bribery that have relevance to Shell and its shareholders.

An article by The Economist under the headline “Graft work” makes the point that “The most briberiddled sectors are oil, gas, mining, construction and transport.”

GONE are the days when multinationals could book bribes paid in far-flung countries as a tax-deductible expense. These days would-be palm-greasers have to contend with ever-tougher enforcement of old laws, such as America’s Foreign Corrupt Practices Act of 1977, and a raft of new ones in countries from Britain to Brazil.

The other article worth reading is also in relation to the U.S. Foreign Corrupt Practices Act. Shell settles Californian environmental contamination lawsuit for $91 million

Shell’s settlement with 1,491 residents will be a total of $90 million

City officials have announced final settlement agreements involving Shell Oil Co., the city, and hundreds of current and former residents of the Carousel neighborhood in the city’s southern end over a contamination lawsuit stemming from a former oil tank farm at the site.

The details of the two separate settlements between Shell and the city, and Shell and residents, weren’t disclosed during Tuesday night’s City Council meeting. But Shell’s settlement with 1,491 residents will be a total of $90 million divided with attorneys and disbursed by a mediator based on health and property damage claims, according to documents obtained by the Daily Breeze. read more

Thousands of Barrels of Shell Oil Spill Into Niger Delta

BONNY ISLAND, NIGERIA – Niger Delta fishermen are no strangers to seeing oil spill into their waters from leaky pipelines, but even they were shocked by the scale of the slick stretching for miles from a Shell facility across the swamps and into the ocean.

Some 3,800 barrels spilled recently, according to an investigation by Shell and government officials. It ranks as one of the worst in Nigeria for years, local environmental activists said.

A Shell spokesman said that some 1,200 barrels had been recovered as of Tuesday, and “recovery efforts are continuing” at the site on the Okolo Launch on Bonny Island. read more

Prospects of a Shell BP merger

Firstly, falls in oil price and resulting low stock prices tend to result in waves of takeovers.

Examples during the low price era of the late 1990s – early 2000s:

· Exxon took over Mobil
· Statoil took over Saga, Norsk Hydro
· Chevron took over Texaco, Unocal
· Total took over Fina and Elf
· BP took over Vastar, Amoco and Arco

Shell is notably absent from this list – over the past ten years the gossip on the street has considered possible mergers involving Shell, BP and Total and even the demerger of Shell Oil, but the numbers apparently did not add up. Perhaps the fall in share prices over the past six months and a lack of exploration opportunities has once again made mergers more attractive than organic growth. read more

The evergreen rumor that Shell could be looking to buy BP returned to the market Tuesday — and sent share prices of both companies higher.

Ever since Lord Browne, BP’s former chief executive, confirmed in his 2010 memoir that cautious talks to this effect took place in 2004, the potential megamerger of the two London-listed oil giants has whetted appetites in the markets.

Yet BP and Shell declined to comment on the rumor, and industry sources were sceptical of the deal. Neither company appears to have retained new banking advisers, often a sign that a deal may be on its way. read more

Its Alaskan Arctic operations have proved frustrating and it has given up on a natural gas project in Saudi Arabia. Meanwhile, a parliamentary committee in Nigeria is demanding it pay nearly $4bn in compensation for an oil spill in 2011.

The Independent: Oil companies BP and Shell in the takeover spotlight

Shares in Britain’s two oil champions – Shell and BP – have jumped as market rumours swept the City claiming the pair were planning a merger, highlighting jittery times for the industry at a time of five-year lows in the oil price.

Despite the fact the story was rubbished by City analysts, the speculation continued that Shell could buy its smaller rival in a deal that would be worth more than £200bn. BP’s share price jumped 5 per cent to 433.85p, valuing the company at £79bn. Shell shares rose 4 per cent to 2,292p, giving it a stock market value of £142bn. read more

Oil and gas majors BP and BG Group were in demand on talk the two companies had been left vulnerable to predators after steep falls in their share prices.

BP spiked in afternoon trade and closed 19.35p higher at 433.85p – a 4.7pc gain – amid chatter that Royal Dutch Shell is eyeing a bid approach.

Minutes after BP surged, the excitement spread to gas group BG, which rose 30.9p, or 3.4pc, to 935½p on two rumours: one of a potential takeover by Shell, the other that ExxonMobil and Chevron were considering a break-up of the company. read more

A few days ago I published an article pointing out that the Shell Business Principles document, proclaiming Shell’s core values and setting out the ethical platform on which Royal Dutch Shell supposedly operates, is conspicuously out of date.

The version published on shell.com still bears the name of Peter Voser who resigned as Shell CEO in controversial circumstances a year ago.
