Nigeria’s Ogonis Divided Over Resuming Oil Production

KEGBARA DERE, NIGERIA—

Oil once flowed in Ogoniland, as it does from wells throughout the creeks and swamps of Nigeria’s Niger Delta region.

But in 1993, the Ogoni people said enough. Leaking pipelines were polluting the fields they farmed and the waterways they fished.

Oil giant Shell was forced to pull out of Ogoniland that year in the face of protests led by the charismatic Ken Saro-Wiwa, head of the Movement for the Survival of the Ogoni People, or MOSOP. He was hanged two years later by the military dictatorship that ran Nigeria, in a move widely seen as retaliation for his activism. read more

Kiobel v. Shell ruling: serious setback to Ogoni in Niger Delta

Screen Shot 2013-04-22 at 08.33.48

Screen Shot 2013-04-22 at 08.38.43The US Supreme Court dismissed a lawsuit against the Royal Dutch Shell Petroleum Company brought by alleged human rights victims. The ruling, which was handed down last Wednesday, is seen as a serious setback for the Ogoni community in the Niger Delta, who alleged gross human rights abuses during the mid-1990s by the military government in power at the time.

Information reaching the African Cultural and Fundamental Rights Council (AFCRC-USA) has it that the oil company, which happens to be the foremost in Nigeria for over 50 years, have been using heavily armed soldiers to clear the Ebubu Eleme oilfield in Ogoni. The corporation is also said to be engaging in other activities villagers believe could be oil extraction against the people’s wishes. read more

Self-Government for Ogoni Was Overdue, Says Goodluck Diigbo

4 August 2012

MOSOP President/Spokesman, Dr. Goodluck Diigbo has been speaking on the reason for the urgency behind the Ogoni declaration of self-government to enforce the United Nations Declaration on Rights of Indigenous Peoples.

Diigbo stated that:“The Ogoni declaration of self-government now guarantees the Ogoni people the right to participate in decision-making in all matters which would affect their rights, through representatives chosen by Ogonis in accordance with own procedures, as well as to maintain and develop all our own indigenous decision-making institutions, which we started to set up since 2011.” read more

British Prime Minister David Cameron Acting Dangerously Against Nigeria

British Prime Minister David Cameron Acting Dangerously Against Nigeria

MOSOP President/Spokesman, Dr. Goodluck Diigbo has described British Prime David Cameron’s government amicus brief in the Ogoni case of Kiobel v Shell in the United States of America as an ill-advised and short-sighted colonial tactics.

How Suing Shell Could Backfire on Human Rights Activists

Nov 17 2011, 9:00 AM ET

International groups have long been using a 1789 tort to sue corporations for acts on foreign soil. An upcoming Supreme Court case might put an end to that.

REUTERS

This past October, a 15-year legal battle between Royal Dutch Petroleum and a Nigerian political movement finally went before the Supreme Court — of the United States, that is. On October 17, the Court decided to hear a lawsuit filed by Esther Kiobel, whose husband, Dr. Barinem Kiobel, was one of nine activists from the Movement for the Survival of the Ogoni People hanged by Sana Abacha’s military government on November 10, 1995. Kiobel alleges Shell was partly responsible for her husband’s death, and for other human rights violations committed in the oil-rich Ogoniland region. read more

SCOTUS to decide if corps. liable for torturing aliens, citizens

Almost as soon as the U.S. Court of Appeals for the Second Circuit concluded last year in Kiobel v. Royal Dutch Petroleum that corporations are not liable in U.S. courts under the Alien Tort Statute for abetting overseas atrocities, the ruling looked like U.S. Supreme Court bait. As I’ve reported, the D.C. Circuit, the Eleventh Circuit, and the Seventh Circuit have all come to the opposite conclusion about corporate liability under the ATS. The only question was which ATS case the high court would choose as the vehicle for deciding whether corporations can be sued for helping foreign governments violate international human-rights law. read more

U.S. Supreme Court to hear bid to sue Shell for Nigerian abuses

17 October 2011

WASHINGTON (AP) — The Supreme Court says it will use a dispute between Nigerian villagers and oil giant Royal Dutch Shell to decide whether corporations may be held liable in U.S. courts for alleged human rights abuses overseas.

The justices said Monday they will review a federal appeals court ruling in favor of Shell. The case centers on the 222-year-old Alien Tort Statute that has been increasingly used in recent years to sue corporations for alleged abuses abroad.

The villagers argue Shell was complicit in torture and other crimes against humanity in the country’s oil-rich Ogoni region in the Niger Delta.

A divided panel of federal appeals court judges in New York said the 18th century law may not be used against corporations. More recently, appellate judges in Washington said it could.

ADDED BY JOHN DONOVAN: SHELL IN NIGERIA

Shell’s horrendous track record in Nigeria includes embedding spies in the Nigerian government; paying rival militant gangs; engaging in corruption (not only in Nigeria); arming police spies; using a private spy firm (Hakluyt) partly owned and controlled by Shell directors, to infiltrate Nigerian activists (friends of Ken Saro-Wiwa) and linking Shell with murder and human rights abuses which are the subject of the above case. Questions inevitably arise about financial linkage to Shell of the militants responsible for the repeated attacks against Shell pipelines and infrastructure over many years, which has driven up the cost of oil. Shell has such a shameful record in Nigeria, including plunder and pollution on an epic scale, that it has even considered ditching the Shell global brand name. Such a radical move would also distance the company from its Nazi past. read more

Shell battles its North Sea oil spill from pipeline below the Gannet Alpha platform

By Rob Davies: Last updated at 10:59 PM on 16th August 2011

Shell is facing a burgeoning image crisis as its North Sea oil spill – the biggest in British waters for a decade – stretched into its seventh day.

The Anglo-Dutch giant has been using teams of divers and Remote Operated Vehicles (ROVs) to battle the leak, which is estimated to have slowed from five barrels a day to two.

But initial work on the sub-sea pipeline below the Gannet Alpha platform succeeded only in plugging one part of the damaged pipe, forcing oil out elsewhere.

The company estimates that some 1,300 barrels of oil have been spilt so far.

In the context of BP’s oil spill in Gulf of Mexico last year – which saw an estimated 4.9m barrels of oil gush into US waters – Shell’s leak is relatively small. read more

Supreme Court Set to Decide Corporate Liability for Human Rights Violations

Tom Ramstack: August 15, 2011 07:14 pm EDT

The Supreme Court is expected to decide within weeks whether it will hear a case on the liability of U.S. corporations for human rights violations in other countries.

The issue has simmered for years as human rights advocates accused corporations of abusing residents of mineral rich areas overseas to evade U.S. laws that never would allow the same kind of exploitation.

The dispute came to a head in recent lawsuits against oil companies Royal Dutch Shell PLC and Exxon Mobil Corp. for their oil exploration in Nigeria and Indonesia. read more

MOSOP challenges integrity of UNEP Report

Press Statement issued by Dr. Goodluck Diigbo MOSOP President/Spokesman

AUGUST 5, 2011

At a MOSOP Emergency General Meeting in Bori, headquarters of Ogoniland on August 4, 2011, MOSOP welcomes the increased awareness the UNEP report on Ogoniland is likely to create about the continued threat of possible extinction to the Ogoni people arising from oil operations in the past 55 years. However, MOSOP resolves to dispute the integrity of the UNEP Report on Ogoniland, which was paid for with $9.5 million by the polluters, including Royal-Dutch/Shell.

MOSOP President/Spokesman, Dr. Goodluck Diigbo, says MOSOP is challenging the integrity of the report, recalling an earlier confession by UNEP team leader Mike Cowing that the report has been informed by data and information solely supplied by Shell and the government, without actual study on the ground. The purported UNEP meeting with 23,000 Ogonis is only on paper, and there is no evidence to prove who attended, what review was done, agreements reached, if any and Ogonis who signed such agreements as proof of public participation as part of the Environmental Impact Assessment Study, EIAS due process. read more

Oil in Nigeria: a history of spills, fines and fights for rights

guardian.co.uk home

On Wednesday Shell admitted liability for two massive oil spills in Nigeria. Ever since oil was discovered in the country in 1956, it has been a source of strife

: Thursday 4 August 2011 09.22 BST

Oil was first found in Nigeria in 1956, then a British protectorate, by a joint operation between Royal Dutch Shell and British Petroleum. The two begun production in 1958, and were soon joined by a host of other foreign oil companies in the 1960s after the country gained independence and, shortly after, fell into civil war.

The rapidly expanding oil industry was dogged in controversy from early on, with criticism that its financial proceeds were being exported or lost in corruption rather than used to help the millions living on $1 a day in the Niger delta or reduce its impact on the local environment. read more

Shell accepts liability for two oil spills in Nigeria

Shell faces a bill of hundreds of millions of dollars after accepting full liability for two massive oil spills that devastated a Nigerian community of 69,000 people and may take at least 20 years to clean up.

Experts who studied video footage of the spills at Bodo in Ogoniland say they could together be as large as the 1989 Exxon Valdez disaster in Alaska, when 10m gallons of oil destroyed the remote coastline.

Until now, Shell has claimed that less than 40,000 gallons were spilt in Nigeria. read more

Ogoni pollution: Delayed release of UNEP report is suspicious?

Press Release

July 21, 2011

Ogoni pollution: Delayed release of UNEP report is suspicious, says ERA

The Environmental Rights Action/Friends of the Earth Nigeria (ERA/FoEN) and other civil society groups have cautioned the United Nations Environment Programme (UNEP) from further prevarication on the planned release of its two-year assessment of the environmental and public health impacts of oil spills in Ogoniland.

In a statement issued in Lagos, ERA/FoEN said the people of Ogoniland and the entire Niger Delta are becoming worried over UNEP’s continued delay in releasing the report after failing to honour a pledge to do same earlier in the year. read more

Maura Harrington update on Shell Corrib project

Dear John,

I’ve attached for your perusal up to the minute stuff connected with the proposed Shell/Corrib project in north Mayo.

There are two attachments from the Peoples’ Forum proceedings held at the weekend – Mrs Joy Phido’s was printed as a supplement and included with the main copy of contributions. Mrs Phido’s willingness to travel from London was very much appreciated by the local community and the empathy which has always existed between the Ogoni people and ourselves was once again underlined; there were also very good contributions from those with a national profile – Kieran Allen, Harry Browne and Colm Rapple together with local contributions from Niall King, retired Principal Rossport Primary School and Sam from the Solidarity Camp not forgetting of course Majella McCarron’s paper on the current and developing area of Human Rights. read more

NNPC to Begin Production On Shell’s Ogoni Oil Wells

By Chika Amanze-Nwachuku Published 28 January 2011

The Nigerian National Petroleum Corporation (NNPC) said Thursday that the Nigeria Petroleum Development Company (NPDC), its producing arm, will soon commence production from the 30 oil fields belonging to Shell Petroleum Development and Production Company (SPDC) in Ogoniland.

Group Managing Director (GMD) of NNPC, Engr. Austen Oniwon, who confirmed the development in an interview with journalists in Abuja, said the move was in line with the Corporation’s mandate to produce 250,000 barrels of crude oil per day in 2015. read more

Nigeria: Maybe Shell isn’t that bad

By Emily Grainger

I am currently investigating Shell’s position within Nigeria, more specifically the Delta; when I came across your website. It is crammed with an insane amount of information I can’t even begin to take half of it in, it’s a great resource, thanks.

Something I never thought I would say before investigating their operations in the war zone that is the Delta is that maybe Shell isn’t that bad. I am more than sure this comment will rub a few backs up – passionate is an understatement for the debate established on here! I don’t think I’ll ever be able to say categorically whether or not as a company I think they are ethical or not. YES they chose the Nigerian Government over local communities as their key stakeholder, but that’s because without them they wouldn’t be able to operate at all within the region let alone country. read more

Payback time for corporate villains?

(Graphics from the Guardian article: Unloveable Shell, the Goddess of Oil)

“Although Shell has extracted more than £30bn from the area, the people who live on the land survive on less than 60 pence a day, with barely any roads, schools or hospitals. Many of the Ogoni people who have spoken out against this scandal have been killed by the Nigerian state.”

By Johann Hari

At the moment, foreign victims of UK corporations are left with almost no ability to answer back

Article first published: 08 June 2006

At first glance, it seems almost comically boring, a triple dose of political Mogadon. The Company Law Reform Bill appeared for its second reading in the House of Commons yesterday, and although it’s easy to see why the biggest reform of Britain’s corporate rules in 150 years is a big deal, it’s hard to keep your mind focussed on the 900 pages of mind-numbing detail – until you realise one thing. There is a clear path running from these dry, jargon-packed pages to a human rights campaigner hanging by his neck on a rope in Nigeria and to the trashed rainforests of Indonesia. read more

The attention of National Union of Ogoni Student’s, USA has been drawn to the recent attack by the combined forces of the Nigerian Joint Task Force and the Rivers State Task Force on the people of Ogoni, particularly the communities of Kpean, Bean, and Gure, etc.

We wish to use this medium to draw the attention of the good people of Nigeria and the world to this fresh line of attack on the innocent people of Ogoni by the River State government. The people of Ogoni are peace loving and have demonstrated this in their nonviolent approach to their demands which are yet to be met. The people whose ONLY crime is the fact that they demand for a fair share of their oil proceeds will continue to resist all forms of oppression with every civil means. read more

Ogoni Will Reject UNEP Assessment Report

By Ogoni Activist Ben Ikari

Ogonis will reject any aspect of the United Nations Environmental Program (UNEP) report, which may conclude that the nationality is responsible for more than 90% of oil spills it’s assessed. This warning is coming before the planned report due for publication about December is erroneously celebrated.

And it’s a serious warning. Therefore the world should take note before UNEP’s coordinator, Mike Cowing conspires with $hell Oil and the Federal government of Nigeria (who are in joint-venture business and sponsoring this assessment) to dent Ogoni for whatever prize he may be given. read more

FAREWELL PRESIDENT YAR’ ADUA OF NIGERIA

The Ogoni people and National Union of Ogoni Students’ USA shall always remember him for his calm demeanor, professional decorum as he approached turbulent issues in Nigeria. He had a listening ear. Ingrained on our minds is his support of the position of the Ogoni people against Shell Oil Company.

Ogoni supporters protesting in New York last month, shortly before Shell agreed a $15.5m settlement in their case

Serious questions over Shell Oil’s alleged involvement in human rights abuses in Nigeria emerged last night after confidential internal documents and court statements revealed how the energy giant enlisted the help of the country’s brutal former military government to deal with protesters. read more

NUOS INTERNATIONAL UNHAPPY WITH “SETTLEMENT” IN WIWA V.SHELL OIL

Shell Oil maintained, "The payment was part of a "process of reconciliation." We are reminding the world that 99.9% of Ogoni people still unequivocally maintain that Shell Oil remains persona non grata in Ogoniland. Shell Oil has refused to accept any guilt and we wonder why they agreed to settlement if they were not guilty. Ogonis are not ready to reconcile with Shell Oil and any covert or overt attempt by the company to step into Ogoni for Oil extraction would be totally resisted.

Ken Saro-Wiwa v Shell oil unfurls: how the Guardian covered it

Shell, one of the world's biggest oil firms, is accused of complicity with the then Nigerian government in the execution of Ken Saro-Wiwa, a well-known environmental activist and author, and several other campaigners against the oil industry. Here is how the Guardian has covered the story since the early 1990s

Shell’s $15.5m settlement: the robber barons knocking at the Ogoni door

By John Donovan

The Ogoni people are being played for fools. A few will become rich as a result of the so-called settlement, while the vast majority will remain poor and pitilessly exploited, as always.

Read between the lines of what Shell Executive Malcolm Brinded has said in the carefully co-ordinated media campaign.

“We believe this settlement will assist the process of reconciliation and peace in Ogoniland, which is our primary concern.”

The real purpose of the paltry $15.5 million is as a re-entry fee to once again plunder the hydrocarbon riches of the Niger Delta: an entry payment for future exploitation, not compensation or genuine atonement for past sins. Note that many other Shell related stories were generated yesterday by the Shell propaganda machine in an unsuccessful attempt to bury news of the so-called settlement. read more
