Corruption is a growing issue in a world that is nearing complete transparency – these problems are not out in the open. Many schools, from top undergraduate business programs to top masters degree programs, are taking them on with increased education, but what about the professional world which already exists?

In 2008, Pricewaterhouse Coopers commissioned a study on corporate corruption entitled Confronting Corruption. In the study, some astounding levels of corruption were revealed. Of the 390 senior executives interviewed for the study, sixty-three percent stated that they had experienced some form of corruption, while forty-five percent stated that their company had forgone business opportunities in a particular market, environment or sector because that area was feared to be corrupted. read more

Royal Dutch Shell has taken action in an attempt to neutralize planned anti-corruption transparency rules that would force Shell, and other natural resource companies, to disclose all payments to foreign regimes.

The Financial Times reports that Royal Dutch Shell has taken action in an attempt to neutralize planned anti-corruption transparency rules that would force Shell, and other natural resource companies, to disclose all payments to foreign regimes.

The new rules are intended to cover EU and US quoted businesses.

Their purpose is to identify corrupt regimes receiving major income from extractive industries, including oil and gas, who siphon off the proceeds.

According to the FT, Shell CFO Simon Henry has written to the UK business minister, Norman Lamb, setting out the oil giants concerns and pushing a series of alternative proposals, which would dilute the anti-corruption rules. read more

People always say the Bush administration is in bed with the oil companies, but it turns out to be literally true.

According to the Interior Department, some government officials in charge of collecting oil and gas royalties smoked pot, snorted cocaine and had sex with employees of big energy firms.

Meanwhile, the rest of us were getting screwed at the gas pump.

Three reports delivered last week to Congress portray “a culture of ethical failure” in which employees of the federal Minerals Management Service often accepted gifts from oil and gas interests, steered lucrative contracts to cronies and partied hard with those with whom they did business on behalf of the U.S. taxpayer. read more

Shell Pays $10 Million Fine to Nigerian Government

Royal Dutch Shell Plc paid $10 million in fines to the Nigerian government over alleged bribes paid on its behalf by Panalpina Welttransport Holding AG, to Nigerian customs officials, Justice Minister Mohammed Adoke said.

The settlement is part of a broader resolution of bribery allegations involving companies operating in Nigeria, Africa’s top oil producer and most populous nation. JGC Corp. of Japan has “proposed settlement talks” in connection to its role in a $180 million bribery case, Adoke told reporters today in Abuja, the capital. No one answered phone calls to JGC’s office in Tokyo outside normal business hours. Tony Okonedo, Shell’s Lagos-based spokesman, declined to comment when reached on his mobile phone today. A message left outside normal business hours for Martin Spohn, spokesman for Basel, Switzerland-based Panalpina, was not immediately returned. read more

When I was at Shell Research many years ago I was in a position of evaluating vendor services and making recommendations about those services to the rest of the company.

The two biggest companies I dealt with were, of course, Schlumberger and Halliburton. My work required access to proprietary material from both companies so it was absolutely imperative that the relationships were kept completely professional.

As such, I would not allow these guys to buy me so much as a bottle of Coke. Nor would I buy their people so much as a Coke. When you are in such a position you can not play favorites and you cannot get ‘cozy’ with any particular vendor or with any of their people. It is inevitable that you do develop ‘professional’ relationships with your contacts in these companies, but they must be kept ‘professional’. I essentially followed the ethical standards of conduct of the US Navy’s Naval Reactor Program Office in my dealings with the vendors, which I was familiar with. read more

When I worked for Shell USA years ago we had an incident with one of our major supplies of oil field services. As it happened the VP of marketing complained to our Shell VP in New Orleans about the fact that their service reps kept handing out free tickets to ball games, took the engineers out to dinner, etc., but that they weren’t ‘getting any’ business. This particular vendor marketing VP thought that Shell’s engineering staff were taking advantage of them (which they were) and they wanted some business in return for all the ‘favors’, etc., they had done for the staff. read more

RESPONSE TO: What did Shell Oil President John Hofmeister know about corruption in Nigeria?

Panalpina and Hofmeister, bribes in Nigeria. I am certain that the top management knew all about the goings on. About 5 years ago a scandal nearly erupted but was quenched. (Or as the say in Nigeria: ‘de disting was quench-oh by de Oga’.

SPDC had made around 500 million dollars disappear over the years to all kind of community projects. No trails could be found in the books. And this for a company that should be able to trace every dollar spent anywhere. Because it is shareholder’s or taxpayer’s money. So I am sure that Hofmeister et all just assumed the bribes via Panalpina would disappear in the great wash. I am not an accountant. But as an engineer I know we can and must and do certify for instance every weld on long pipelines. The exact location, date of weld, weldingrods used, name of welder, and an X-ray photo is included. If you can do that, you should be able to trace every dollar spent? Unless you don’t want to?!? read more

The Panalpina investigation began in 2007. The investigation covers the time period of 2002 -2007. That means, of course, that Shell’s transgressions occurred during John Hofmeister’s term of service at Shell. One has to wonder what his involvement in the bribery schemes were. I am certain that he was fully aware of what was going on, given that he was President of Shell USA from 2005 -2008. Someone had to ‘sign for’ and approve the millions of dollars used for that purpose. read more

The company said Shell’s Nigerian employees “specifically requested Panalpina Nigeria to provide false invoices with line items to mask the nature of the bribes.” Shell wanted to “hide the nature of the payments to avoid suspicion if anyone audited the invoices,” Panalpina said.

Shell separately admitted paying $2 million to Nigerian subcontractors on its deepwater Bonga Project. Shell knew some money would go as bribes to Nigerian officials to circumvent the customs process and give the company “an improper advantage,” according to its admission in federal court in Houston.

Nov. 5 (Bloomberg) — Bribes paid on behalf of Royal Dutch Shell Plc’s Nigerian unit came from “a culture of corruption” that Panalpina World Transport Holding Ltd., a Swiss freight forwarder, admitted in a U.S. court yesterday.

Panalpina, Shell and five oil services companies agreed to pay $236.5 million to settle probes by the U.S. Justice Department and Securities and Exchange Commission. Panalpina, which admitted to bribing government officials in seven nations, will pay $81.5 million, and Shell will pay $48.1 million. read more

WASHINGTON—A big Swiss shipping and logistics company and Royal Dutch Shell PLC, one of its customers, are close to settling foreign-bribery charges stemming from a three-year U.S. investigation, said people familiar with the matter. It could be the first in a series of such settlements by major multinational companies.

Panalpina Group, which has 14,000 employees and branches in more than 80 countries, has been at the center of a sprawling probe into whether it paid officials in places including Nigeria, Saudi Arabia, Algeria and Kazakhstan to expedite services, such as clearing drilling rigs and other equipment through customs, according to people familiar with the matter and corporate disclosures. read more

In a wide-ranging foreign-corruption investigation, fired former Halliburton Co. executive Albert J. "Jack" Stanley pleaded guilty to orchestrating more than $180 million in bribes to senior Nigerian government officials. More than window-dressing but not enough to draw a line under sustained criticism: Lord Woolf’s report on ethical business conduct at BAE Systemscontains 23 specific recommendations to bring about and underpin a serious change of culture at Europe’s largest defence contractor. Yet the Woolf committee’s authority is inevitably diminished by a remit that meant it could not address past corruption allegations, notably in Saudi Arabia.

The report has several practical ideas about how to make ethical behaviour a priority at BAE. It sets new terms for the use of advisers and seeks to end facilitation payments. It gives the board an explicit role in assessing ethical and reputational risk. It demands that BAE commission and publish an independent audit of its conduct within three years. If fully implemented, the report would make BAE a benchmark of best practice in a sector not known for openness. read more
