Shell climate lawsuit: Dutch activists push courts for steeper emissions cuts

Companies that make money selling coal, oil and gas could be held more accountable if judges in the Hague order fossil fuel giant Shell to cut its emissions.

Backed by 17,000 Dutch citizens, climate activists are wrestling fossil fuel giant Royal Dutch Shell in court over its responsibility to cut emissions to levels that comply with global treaties.

On the last of four days of hearings in the District Court of the Hague, seven environmental groups led by Friends of the Earth Netherlands pressed the court to force the oil major to commit to the Paris Agreement target of keeping warming to 1.5C. This would mean cutting net carbon emissions by 45% from today’s levels in a decade, the campaigners say, at a time where Shell is still investing heavily in fossil fuels. read more

Employees of Shell’s Nigeria subsidiary SPDC ordered the deliberate vandalization of oil pipelines to profit from them, according to a Dutch TV documentary, done in partnership with environmentalist organization Milieudefensie.

Aljazeera reports that the program, to be aired today, cites witnesses who said pipeline leaks were caused by SPDC employees.

“According to sources, Shell employees profit from these intentional oil leaks by pocketing money from clean up budgets,” the program, Zembla, said. read more

Shell faces UK supreme court case over Niger delta pollution

The fossil fuel company Shell must be held accountable for significant and systematic pollution caused by oil extraction in the Niger delta, lawyers will argue in the supreme court.

Nigerians from the Ogale and Bille communities say they have suffered decades of pollution, including the contamination of their water wells with potentially cancer-causing chemicals, as well as the devastation of mangrove vegetation, all of which was documented by the UN in a groundbreaking report in 2011.

The United Nations environment programme (UNEP) said in its report it could take 30 years to clean up the pollution caused by oil extraction and recommended an initial fund of $1bn (£800m) for the first five years to be paid by the oil companies that operate in Ogoniland – including the largest company, Shell. read more

Justice Inyang Ekwo of the Federal High Court, Abuja, has made a garnishee order compelling the Central Bank of Nigeria (CBN) to pay the people of Ejama Community in Eleme Local Government Area of Rivers State a total sum of N182.7 billion. The amount is to be deducted from the account of First Bank of Nigeria Plc. in the custody of the CBN.

Lawyers to Ejama community told THISDAY last night they have since served the CBN the garnishee order absolute.

Canada’s LNG Dreams Fade as Blockades Add New Costs to Industry

Hopes that Canada could turn into a gas export powerhouse seem to be waning fast.

The current climate for energy investments in the country and the global market for liquefied natural gas are a far cry from October 2018, when a Royal Dutch Shell Plc-led group announced plans to build a massive LNG terminal on British Columbia’s coast and Prime Minister Justin Trudeau hailed the project as “a vote of confidence” in Canada.

The latest sign of disenchantment came this week as a C$9 billion ($6.7 billion) LNG project in Quebec lost a large potential investor, which the Canadian Broadcasting Corp. identified as Warren Buffett’s Berkshire Hathaway Inc. That follows announcements last year that Chevron Corp. is planning to sell its 50% stake in an LNG project in British Columbia, and its partner in the venture is seeking to trim its stake as well. read more

Extinction Rebellion: The more successful fossil fuel companies like Shell are, the worse our future is going to be.

Climate change activists have blocked the entrance to the headquarters of oil giant Shell in Aberdeen.

Extinction Rebellion Scotland members began their protest at the premises on Altens Farm Road at 6.30am on Thursday and said they plan to stay there all day.

The group say they have secured the entrances with lock-on equipment and the main entrance with XR Scotland’s big purple boat, named Amal Gous.

Shell To Challenge Damages Award Made In Nigeria After 1969 Oil Spill

(Alliance News) – Royal Dutch Shell PLC is mounting an appeal after a judge in Nigeria made a GBP33 million damages award following an oil pipeline rupture half a century ago.

Bosses are preparing to challenge the 2010 ruling, made after a hearing in the Federal Court of Nigeria, in the Nigerian Supreme Court.

Detail of the appeal was outlined on Thursday in a ruling by a judge who considered issues in the case at a High Court hearing in London.

Judge Jason Coppel heard that a lesser ranking judge in London had earlier this year “registered” the Nigerian ruling in England. read more

Shell Vows Not To Return Pumping Oil In Troubled Nigerian Region

SPDC, as operator of the SPDC Joint Venture, carried out exploration and production operations in Ogoniland from the 1950s until the early 1990s. Production ceased in 1993 following a rise in violence, threats to staff, and attacks on facilities, Shell said. read more

Dutch government to review Groningen gas plans after latest quake

A 3.4 magnitude earthquake has hit the northern Dutch region of Groningen in the latest in a series of tremors blamed on decades of gas extraction.

The Dutch government says it will decide in the coming weeks whether the quake should lead to a change in plans to end production from the Groningen field by 2030.

The government has pledged to end production from the field by 2030 and to lower it as quickly as possible in coming years; output is set to fall to 19.4B cm in the year through October 2019, down from a peak of 54B cm in 2013. read more

The District Court of the Hague has issued an interim ruling in favour of wives of Ogoni leaders killed in 1995 during the military era of Sani Abacha.

The case, which was instituted by four wives of the slain leaders — Esther Kiobel, Victoria Bera, Blessing Eawo and Charity Levula — accused Shell of being involved in the decision by the Nigerian government that led to the killing of their husbands.

The plaintiffs are also calling on the court to order Shell to hand over more than 100,000 internal documents crucial to the case. Shell’s lawyers have refused to do so, even though these documents were submitted as evidence in the US case.

Shell had said that the Dutch court lacked jurisdiction to hear the case, but the court ordered that the case must continue.

In its ruling on Wednesday, the court ordered that the case should not be time barred, while also granting the prayers of the plaintiffs that Shell should hand over the confidential internal documents to the plaintiffs’ lawyers, and that they would have the opportunity to examine witnesses.

Amnesty International, an international human rights organization, supported Kiobel’s legal team to bring the case to the Netherlands in 2017, and detailed Shell’s role in the arrests and executions in a briefing. read more

LAGOS, April 30 (Reuters) – Two Royal Dutch Shell oil workers who were kidnapped in Nigeria’s southern Niger Delta region last week have been rescued, a police spokesman and Shell Petroleum Development Company of Nigeria Limited (SPDC) said on Tuesday.

Kidnappings for ransom occur in much of Nigeria, Africa’s biggest oil producer, but are particularly prevalent in the Niger Delta which produces the majority of the country’s crude oil.

The pair were attacked in southern Rivers state last week while returning from an official trip to Bayelsa state. read more

AMSTERDAM (Reuters) – Environmentalist and human rights groups said on Friday they had started a lawsuit against Royal Dutch Shell in the Netherlands to force the energy firm to cut its reliance on fossil fuels.

The groups, including Greenpeace and Friends of the Earth Netherlands, handed over a court summons to Shell at its headquarters in The Hague, demanding it stop extracting oil and gas and cut its greenhouse gas emissions to zero by 2050.

“Shell spends billions on oil and gas exploration each year, with current plans to invest just 5 percent of its budget in sustainable energy and 95 percent in exploiting fossil fuels,” the groups said. read more

THE HAGUE, Netherlands — Climate activists are planning to deliver a court summons to Shell in a court case aimed at forcing the energy giant to do more to rein in carbon emissions.

The summons is being delivered to Shell’s headquarters in The Hague on Friday afternoon.

The move comes a year after the Dutch branch of Friends of the Earth sent a letter to Shell’s CEO Ben van Beurden accusing the company of “breaching its legal duty of care” by causing climate damage across the globe. read more

Shell sees rise in Nigeria oil spills in 2018

LONDON, April 2 (Reuters) – Royal Dutch Shell last year experienced a sharp rise in the number of oil spills caused by pipeline theft in Nigeria, which the company said were the result of larger output and higher oil prices.

The number of spills caused by sabotage and theft in the Niger delta rose last year to 111 from 62 in 2017, the Anglo-Dutch company said in its annual sustainability report.

The volume of oil spilt as a result rose to 1,600 tonnes, or roughly 12,000 barrels, from 1,400 tonnes the previous year. read more

Henry van der Waerden, the Shell executive who defied Deterding and his Nazi ambitions

The Dutch High Court says it will consider demands on Jan. 17 seeking an immediate end to gas production from the Groningen field, after the government said it would cut output gradually.

The High Court says it received 26 objections to the plan, expressing concerns about seismic risks caused by drilling and demanding an urgent halt in production.

Analysts say the court is unlikely to grant an immediate halt because the Netherlands still depends on Groningen gas for a significant part of its energy supply. read more

The boss of oil giant Shell has admitted he is “still unhappy” with the firm’s safety performance, despite pledging a redoubling of efforts in 2018.

Chief executive, Ben van Beurden, raised a call to redouble the firm’s focus on safety last year after a number of serious incidents in 2017.

An overturned tanker spill and explosion in Pakistan caused the tragic death of 200 people, while there were also fatalities in Canada and Nigeria.

Mr van Beurden added he is also focusing on restoring trust in the oil firm.

Shell sued by Arcadia, Calif. over TCP contamination

Dow Chemical Co and Shell Oil Co have been hit with a lawsuit by the city of Arcadia, California accusing the companies of contaminating the city’s drinking water with a toxic chemical found in pesticides the companies once made.

Filed on Thursday in Los Angeles federal court, the lawsuit said the companies knew or should have known that the chemical, known as 1,2,3-trichloropropane, or TCP is toxic and renders drinking water unsafe.

The companies still manufactured and marketed pesticides containing the chemical for years, the lawsuit said. read more

Remembering Ken Saro-Wiwa 23 years after brutal killing by Nigerian govt

Shell is facing a civil suit in Netherland over its alleged complicity in the killing of Mr Saro-Wiwa and the eight other Ogoni activists. The suit was filed on June 28, 2017, by four of the widows of the Ogoni Nine, led by Esther Kiobel.

It is exactly 23 years today since Ken Saro-Wiwa, a playwright, environmental activist and Ogoni leader was brutally executed.

He was executed on November 10, 1995, by the Nigerian government under the leadership of the then military dictator, Sani Abacha.

Mr Saro-Wiwa and eight of his kinsmen, who became popularly known as the Ogoni Nine, were sentenced to death by a special military tribunal set up by Mr Abacha who later died in June 1998 inside the presidential villa under mysterious circumstances. read more

But for the company that pioneered Nigeria’s oil industry in the 1950s, the Niger Delta remains as important — and problematic — as ever.

I strongly believe that Royal Dutch Shell should be held accountable for its outrageous antisemitic actions against its own employees, which cost some of them their lives. The same applies to Shell’s huge financial support for Nazi Germany that contributed to the deaths of some 50 million victims in WW2 including those poor souls who perished in the Holocaust. Shell’s leader, Sir Henri Deterding, was an ardent Nazi feted by Adolf Hitler. Shell has never apologised or expressed any remorse.  read more

A disagreement in the areas impacted by an oil leak on the Trans Ramos Pipeline within Shell’s oilfield at Aghoro communities in Bayelsa has stalled the release of a Joint Investigation Visit (JIV) report of the oil spill.

Community leaders, who participated in the JIV to determine the cause of the spill reportedly refused to sign the report. read more

Refinery failures led to gas emergency

The release of odourless gas into the national network last September, meaning 10,000 homes had to go without gas for days, was due to poor operating procedures at the Corrib gas refinery in Co Mayo.

A report by the Commission for Regulation of Utilities (CRU) concluded that the emergency on September 21, 2017, was due to a technical failure at the Shell E&P Ireland terminal at Bellanaboy. The CRU said it had followed up its findings with enforcement actions against both Shell and Gas Networks Ireland (GNI), which operates the national gas network. read more

The repair and reinforcement of Dutch homes damaged by gas-extraction earthquakes in Groningen needed to be speeded up, the state supervisor on mines SoDM told economic minister Eric Wiebes.

RTL Nieuws reported that SoDM found approximately 1,900 homes in the region that, if not reinforced quickly, would no longer meet official safety standards. The distinctly Dutch rules state the risk of someone dying in an earthquake must not be higher than the risk of someone drowning in a flood elsewhere in the Netherlands. read more

(Reuters) – A federal court in California dismissed climate change lawsuits by the cities of San Francisco and Oakland against five oil companies, saying the complaints required foreign and domestic policy decisions that were outside its purview.

San Francisco and Oakland sued Chevron Corp, Exxon Mobil Corp, ConocoPhillips, Royal Dutch Shell Plc, and BP Plc last year seeking an abatement fund to help the cities address flooding they said was a result of climate change.

Judge William Alsup of the U.S. District Court for the Northern District of California said in the ruling that the dangers raised by the complainants were real and worldwide, and both parties accepted the science behind global warming. read more

Gas production at Groningen field falling faster than planned

Production at the Groningen natural gas field will come in lower than expected this year as the Dutch government works to end production completely by 2030 in an effort to limit seismic risks in the region.

Output will have fallen to 19B-20B cm in the year ending October 2018, the Dutch gas sector regulator says, below the original cap of 21.6B cm set for the year and down from 24B cm last year.

The Groningen field is a joint venture of Royal Dutch Shell (RDS.A, RDS.B) and Exxon Mobil (NYSE:XOM). read more

CONVENT, La. (AP) — A major oil company is taking steps to honor once-forgotten slaves buried on its land west of New Orleans in an area where sugar plantations once abounded, an effort that some hope will grow into a larger movement to recognize and protect such cemeteries around the country.

The Shell Oil Company marked, blocked off and spruced up the tracts near its Convent refinery west of New Orleans and held dedication ceremonies in March, about five years after archaeologists confirmed the presence of slave burial grounds in 2013. The company also has been working with the nearby River Road African American Museum to arrange commemorative events and accommodate visitors.

It’s the latest example of the South’s decades-long path to acknowledging unsavory aspects of its history. read more

  • The Netherland’s Groningen gas field will produce less than 12B cm/year by October 2020, the country’s economic affairs minister says.
  • The purchase of nitrogen to mixed with imported gas could lead to a reduction in gas extraction of 1B-1.5B cm, the minister says in a letter to the Dutch parliament, adding that Groningen gas production could drop by another 7B cm once the nitrogen plant in Zuiderbroek is operational.
  • In March, Prime Minister Rutte said the government aimed to end all production in Groningen by 2030 due to earthquakes.

    A confidential study that Royal Dutch Shell (RDS.A, RDS.B) has been accused of trying to shield from public view showed worsening “catastrophic” pollution around oil spill sites in Nigeria, WSJ reports.

    At least one of the study’s authors has urged the findings to be widely distributed because they pointed to significant health risks to the local Bodo community in Nigeria but said that Shell had denied him permission to publish the study’s results in a scientific journal, according to the WSJ report. read more

    Royal Dutch Shell Plc will face difficult questions at its annual general meeting next week after an investor-advisory group urged shareholders to challenge executive pay and the company’s response to a fatal accident in Pakistan. 

    Institutional Shareholder Services Inc., an influential adviser on corporate governance, has recommended investors reject Shell’s pay report at its AGM on May 22, saying it was initially “silent” on the Pakistan incident. ISS also said it could only offer “qualified support” to the re-election of the independent director looking after corporate social responsibility.  read more

    Shell writes off Groningen gas field on Dutch phase-out

    LONDON (Reuters) – Royal Dutch Shell said on Thursday it would write down its reserves in the Groningen gas field, one of Europe’s largest, following the Dutch government’s decision to phase out production by 2030.

    The Anglo-Dutch company holds a 50 percent stake in the field, which has seen production reduced in recent years following a series of damaging earthquakes. 

    Shell said it expects to write off an estimated 0.5 to 0.65 billion barrels of oil equivalent in 2018. read more

    SHELL WRITES OFF NAM SHARES OVER GRONINGEN GAS EXTRACTION REDUCTION

    In its bookkeeping, Shell is reducing the value of its interest in NAM to zero in response to the Dutch government deciding to cin the coming years, RTL Nieuws reports.

    Dutch petroleum company NAM is responsible for gas extraction in Groningen. NAM is owned half by Shell and half by ExxonMobil. Depreciating its shares in NAM is costing Shell 244 million dollars, according to RTL.  

    The Dutch government concluded that safety in Groningen can only be guaranteed if the cause of the gas extraction earthquakes in the province is completely removed. The government therefore plans to reduce gas extraction in the province to 12 billion cubic meters by 2022 at the latest. From October 2022 gas extraction will be reduced to 7.5 billion cubic meters “and possibly considerably less”. And after that it will gradually be reduced to zero. read more
