On 25 March 2015, I sent an email to the GSOC at the written invitation of Irish Justice Minister Ms Frances Fitzgerald T.D. supplying new evidence pertaining to the OSSL allegations against Shell E&P Ireland.  

It was in the form of an audio file and related transcript of a covertly recorded meeting between OSSL directors and their Dublin solicitor, Mr Marc Fitzgibbon. He suspected that the meeting was being recorded by OSSL, but said he was not concerned if it was. The alcohol was mentioned over 60 times in the recorded meeting. read more

Shelling Out Sweeteners

The Irish satirical website broadsheet.ie has published an extensive article about Shell sponsored corruption in Ireland involving gifts (bribes) of up to €900,000 in value.  

The website has published two key items; an invoice sent to Shell E&P Ireland by its agent OSSL for £30,000 worth of alcohol supplied to named senior police officers and a transcript of a covertly recorded 42 minute meeting between OSSL and its Dublin solicitor when the alcohol was mentioned over 60 times.

The solicitor in question Mr Marc Fitzgibbon, attended multiple high level meetings with Shell when the supposedly non-existent alcohol was freely discussed. 

Shell has acknowledged receipt of the OSSL invoice raised years after the alcohol was supplied. It should be a simple matter for the police or tax authorities to investigate whether the invoice is legitimate. read more

Third Successive Year of OSSL Pre-AGM Bombardment of Shell Underway

The third successive year of a pre-AGM email bombardment of Shell by its former “Mr Fixit” company in Ireland, OSSL, is fully underway.

Several emails are sent every day by OSSL, not just to top executives at Shell, such as Ben van Beurden  but to the Irish Justice Minister and Senior Irish Police Officers.

The subject is always the same.

The alcohol purchased by OSSL on behalf of Shell, which OSSL distributed to senior Irish police officers on behalf of Shell. Police officers who took delivery are named in the emails. They were also named in a taxation invoice sent to Shell by OSSL for some £30,000 worth of police alcohol.  read more

The Corib Gas pipeline project by the Western Irish fishing village of Rossport, County Mayo, has always been a source of controversy. It was established amid arrests and police batons, against the wishes of locals and environmental protesters. The project is supposed to start pumping gas this summer, and those activists remain convinced that extracting fossil fuels from an area famed for its natural beauty is a bad idea.

Just over a week ago, an 800 metre pipe that was supposed to be fixed to the sea-bed floated to the surface. Feeling that their fears may have been justified, local activists are demanding that the Environmental Protection Agency (EPA) looks into it. I contacted the EPA who had previously said they would be investigating the issue. When I asked whether members of the EPA would visit the site, I was told they “don’t consider it necessary at this time”. read more

It was only yesterday that I posted an article on the above subject after a long break in coverage.

The email from the justice ministry contains an apology for the delay in responding to a communication I sent to the minister several months ago. It related to the admittance by a Shell supplier OSSL, that it had for a long period distributed bribes to the Irish police, and other Irish parties, including land owners, at the express instruction of their client Shell EP Ireland. Update on OSSL Shell Scandal

This is my take on the actual situation according to information I have received today.

After pointing out that a recent Garda Ombudsman Commission (GSOC) investigation found no evidence of the alcohol supplied to Garda officers by OSSL on behalf of Shell and stating that the matter is closed, the Irish Justice Minister, Frances Fitzgerald, grudgingly invited OSSL to contact the GSOC with any evidence to support various related allegations. read more

Irish Police reopen and expand investigation into Shell corruption case?

According to an insider source, the Irish Police Garda Ombudsman Commission has reopened and expanded an investigation into evidence of corruption surrounding the Corrib Gas Project in Ireland.

I understand that this development was prompted by new evidence published on this website in relation to the whistleblower Irish company OSSL. Its directors have admitted distributing bribes on behalf of the Shell led project consortium.

This apparent development seems to be at odds with a statement issued by the Irish Justice Minister Frances Fitzgerald, in the Irish Parliament on 4 December 2014.

OSSL strenuously denies allegations that it has attempted to blackmail Shell and its project partners, Statoil and Vermilion. Shell has provided written proof that it has received hundreds of money demands from OSSL for the alcohol. read more

Danger to Shell from Class Action Lawsuits Arising from Bribery

Two articles have just been published about bribery that have relevance to Shell and its shareholders.

An article by The Economist under the headline “Graft work” makes the point that “The most briberiddled sectors are oil, gas, mining, construction and transport.”

GONE are the days when multinationals could book bribes paid in far-flung countries as a tax-deductible expense. These days would-be palm-greasers have to contend with ever-tougher enforcement of old laws, such as America’s Foreign Corrupt Practices Act of 1977, and a raft of new ones in countries from Britain to Brazil.

The other article worth reading is also in relation to the U.S. Foreign Corrupt Practices Act. Shell corruption that led to blackmail

The invoice for the alcohol has been the foundation of a two year blackmailing operation with OSSL bombarding money demands on Shell for alcohol Shell had already paid for in full. Consequently, the OSSL invoice is of huge significance in relation to alleged very serious corruption and associated blackmail on an unprecedented scale.

On 16 November 2014 I informed a senior Garda officer about an apparent blackmail operation by an Irish company OSSL being carried out against the Corrib Gas Project, led by Shell.

I supplied details from the most recent blackmail note/email sent by OSSL dated 14 November 2014 to various people at Shell, Statoil and Vermilion.

The following day I received an email from OSSL containing an unspecified threat, which I assumed to be a threat to issue a defamation action.

We now have official confirmation that the Garda cops accused of brutality towards Corrib Gas Project protestors were working for Shell.

According to an article published today by The Irish Times, Shell has paid the Garda €158,746 for policing in Ireland, mainly arising from the force’s operation guarding the controversial Corrib gas pipeline in Co Mayo.

The article says:

SHELL FUNDED CORRUPTION IN THE CORRIB GAS PROJECT IN IRELAND

According to an Irish Independent article, the former Irish Justice Minister, Alan Shatter, who corresponded with me in relation to the OSSL corruption allegations against Shell and the Irish Police, has launched a blistering attack on the bosses of the watchdog Garda Ombudsman service (GSOC).  

The GSOC is the hopelessly incompetent outfit responsible for a so-called “investigation” of the OSSL allegations. In fact, they never even approached a key witness, Mr Marc Fitzgibbon, a senior Dublin lawyer. He was personally present during a series of meetings with top people at Shell, when OSSL demanded and Shell agreed to pay OSSL for  goods and services used to bribe various parties on behalf of Shell, including senior Irish cops.  read more

OSSL has now supplied me with evidence confirming that their allegations against Shell are true.

The evidence comes from a person of high repute personally present when senior  representatives of Shell, including the Managing Director of Shell EP Ireland. Michael Crothers, carried out repeated negotiations in an attempt to agree a settlement of monies owed to OSSL for buying the sweeteners on Shell’s behalf, including alcohol.   read more

Update on OSSL Corruption Allegations Against Shell

A contributor to the Shell Blog has requested an update on the long running OSSL saga. OSSL is the former “Mr Fixit” company working for Shell in Ireland that blew the whistle on alleged corruption surrounding the controversial Corrib Gas Project.

There have been two internal investigations by Royal Dutch Shell and three by the Irish police authorities. All reached the conclusion that there is no evidence to support the OSSL allegations.

In fact, there is evidence but for obvious reasons, neither the police nor Shell want to reveal the truth. read more

Shell connection?: Garda laptop found in a Dutch brothel

The Irish Independent newspaper has published an article reporting that a worker at a Dutch brothel discovered a bag apparently containing “a laptop and documents as well as an “insignia” that allegedly identified the owner as being a member of An Garda Siochana”  – the Irish Police force.

Shell whistleblower OSSL challenges Irish police officers to take lie-detector test

OSSL, the company that admits supplying free alcohol to Irish police on behalf of Shell EP Ireland is challenging senior Irish police officers, who apparently deny receiving the goods said to be worth tens of thousands of Euros, to take lie detector tests. 

The challenge is contained in an email sent earlier today to senior executives of Shell including the Company Secretary of Royal Dutch Shell Plc, Mr Michiel Brandjes.

OSSL directors say that they are prepared to take lie-detector tests themselves with Shell representatives in attendance.  read more

Former Irish Shell supplier OSSL, the “Mr Fixit” company that turned whistleblower over Shell corruption of the Garda, has today upped the defamation stakes still higher by putting posters on public display outside Shell EP Ireland HQ in Dublin.

Hence, if Shell decides to defend itself and Corrib manager Brian Foley against the OSSL allegations it claims are false, it will also have to sue me.

No prospect of libel action by Shell or the Garda against OSSL

Áine Ryan of The Mayo News has published an article today under the headline: Shell and An Garda Síochána welcome the report

According to her article, following publication of the Ombudsman findings, both Shell and the Garda have declined to say whether they will take legal action against OSSL “for possible reputational damage due to the public nature of the allegations.”

If you make a serious accusation against a public servant and that individual is subsequently cleared by an official investigation, it becomes an even more serious libel if the same unfounded accusation is repeated.

This upping of the defamation stakes is multiplied in the case of Irish police officers accused by OSSL of handling alcohol purchased by OSSL on behalf of Shell, as they have been effectively cleared of the allegations in FIVE separate investigations. Two by the Garda, two by Shell and the most recent by the Garda Ombudsman Commission (GSOC). read more

Top criminologist calls for inquiry into Corrib policing

The Queen’s University Belfast academic who exposed the South Yorkshire police handling of the 1989 Hillsborough football stadium disaster has supported calls for a full review of the policing of the Corrib gas project in north Mayo.

Criminologist Prof Phil Scraton says international concern about Garda handling of opposition to the gas project reflects a belief that it has “moved beyond a series of specific incidents to something of much greater institutional consequence”.

He considers that the policing of the gas project from late 2006 merits a non-statutory review of all available documentation, which could be a prelude to a full statutory inquiry. read more

GSOC received two complaints, in October 2013, from partners in a company, which alleged that they had supplied alcohol, on behalf of another organisation, to garda stations in Co. Shell cleared of bribing Irish Police, but for how long?

According to a report published earlier this evening by the Irish Examiner, it appears that Shell has been cleared of bribing the Irish police.

Under the circumstances I will expect libel writs in the post from those police officers who I have named as being involved in the corruption which took place. 

Should I be worried? Not at all. 

The verdict of no evidence is in line with the previous internal investigation results by the Irish Police and Shell.

What will it do to the already heavily damaged reputation of the Irish Justice Ministry, the Garda and the Garda Ombudsman Commission, if in fact there is hard evidence proving the OSSL allegations? read more

Garda watchdog finalises investigation into Belmullet garda booze allegations

THE Garda Síochána Ombudsman Commission (GSOC) has confirmed to The Mayo News it is finalising its report about allegations by a former Shell contractor that Belmullet gardaí were given booze bribes. The allegations by services company, OSSL, have been reported in local, national and international media and were the subject of an internal inquiry by Shell and two Garda investigations.

Mr Desmond Kane, of OSSL, has claimed his company was instructed by Shell personnel to deliver a large amount of alcohol to Belmullet Garda Station before Christmas 2007. Shell has rejected the claim. However, Mr Kane says that, because of a dispute with the company, he was never paid for this delivery. He says he did get paid for earlier, smaller booze deliveries and other ‘sweeteners’ to local people. read more

Disarray continues at Irish Police Ombudsman Commission

It is not long off a year since the Garda Siochana Ombudsman Commission (GSOC) begun investigating OSSL whistleblower allegations of police corruption against Royal Dutch Shell in relation to the troubled Corrib Gas Project. 

Although Johan Groenewald, the person leading the investigation,said some time ago that publication of his findings was imminent, the process seems to have ground to a halt, possibly due to other controversial events surrounding the GSOC. 

There is some indication of the degree of disarray by the news today that a high level whistleblower – no less than a deputy chief of the GSOC – has “put the boot into watchdog boss and his former colleagues in a scathing five-page resignation letter.”  read more

Mr Shatter was speaking during a Dáil debate on the Cooke report into allegations of bugging at the Garda Síochána Ombudsman Commission.

Earlier, he said that as minister he had dealt with bugging allegations at the Garda Síochána Ombudsman Commission in a straightforward and truthful manner.

Mr Shatter said it was disturbing that the GSOC commissioners were so “imprecise” in their account to an Oireachtas committee that they fuelled speculation that Mr Shatter’s first statement to the Dáil was inaccurate. read more

The changes to Ireland’s licensing terms for oil and gas announced by Pat Rabbitte today (18th June 2014) are cosmetic and will do little to address the State’s mismanagement of its valuable resources, according to Shell to Sea.[1]

Shell to Sea spokesperson Maura Harrington said: “These changes are cosmetic, Ireland will continue to rely almost exclusively on a tax on profits as a means of extracting revenue from the oil and gas it has given to private companies. We support the recent demands for an inquiry into allegations of systemic Garda corruption and violence. We believe any such inquiry should include the Shell/Corrib pipeline police operation in North West Mayo. This is one of the longest running police operations in the history of the Irish state and has drawn critical attention from national and international human rights organisations1 since 2006 over the alleged violence and intimidation used by Gardaí against campaigners.

In 2007, campaigners submitted complaints en masse against the Gardaí to the newly established Garda Síochána Ombudsman Commission (GSOC). Out of the 111 complaints received by GSOC between May 2007 and November 2009, 78 were deemed admissible and 7 sent to the DPP. The DPP rejected prosecution in all 7 cases. The majority of campaigners have since stopped submitting complaints to GSOC. In 2010, complaints from 400 Kilcommon residents were submitted to Shell’s Belmullet office detailing the “escalating physical and psychological harassment” continuing in the area. In 2012, residents again submitted a mass complaint, this time to Mayo County Council, outlining serious grievances arising out of the project, including experiences of private security and state policing, with no result. Any inquiry into the policing of the Shell/Corrib Gas Project cannot ignore the following extract from the minutes of the Shell Committee of Managing Directors meeting held in London 22/23 July 2002:”It was noted that development of the Corrib field may be delayed until 2004 as planning consent had been refused for the terminal. The committee queried whether the Group had sufficiently well placed contacts with the Irish government and regulators. Paul Skinner undertook to explore this issue further in consultation with the Country Chairman in Ireland”. read more

Where is the queue to issue libel writs against John Donovan?

No, not a chance, because they know the truth and have got no intention of taking any action that ends up with them having to give evidence under oath. Consequently there is not a single soul who has or will take legal action.

Garda Ombudsman Investigation of Shell Corruption allegations in disarray

The investigation of allegations made by a Shell whistleblower company OSSL, of alleged Shell sponsored corruption of the Irish police, appears to be in a shambles following ill-judged on-the-record comments by the officer leading the inquiry, Johan Groenewald.

In the exchanges, which became heated on his part, Mr Groenewald denounced OSSL as being untrustworthy, rubbished and disregarded vital evidence, issued a threat against me and denied that he tore up (and has apparently disregarded) statements given to a senior Garda officer by OSSL directors. At some point he seems to have lost his impartiality.  read more

I sent an email earlier this week to Johan Groenewald, the officer in charge of the Garda Ombudsman (GSOC) investigation into OSSL allegations of Irish police corruption sponsored by Shell, relating to the controversial Corrib Gas Project.

I did not anticipate any response because Mr Groenewald had indicated through OSSL that he did not want to receive any emails from me.

Against expectations,  he did respond and has since engaged in a flurry of email correspondence with me, the tone of which was initially constructive and polite, but deteriorated earlier today when he resorted to issuing a threat and then sent a parting email message, before blocking my emails so I could not reply. read more

Printed below is a transcript of a self-explanatory exchange at the Shell AGM this morning involving Desmond Kane representing whistleblower company OSSL and Jorma Ollila (Chairman) and Ben van Beurden (CEO) representing Royal Dutch Shell Plc.

Note that Ben van Beurden repeatedly stresses that there is no evidence to support the allegations OSSL is “fond of making.”

What he does not say is that the alleged events never happened.

And what about the evidence of the OSSL invoice to Shell? Is Shell saying that the OSSL invoice is a fake? If so, Shell should call in the police. It would be their duty to do so. read more
