I would like to inform readers of the article posted by the Malaysian humanitarian, Dr John Huong, on Tell Shell yesterday, 13 September 2005, that he is unable to exercise his fundamental right to freedom of speech.

This is because EIGHT companies within the Royal Dutch Shell Group (listed below) collectively obtained a High Court Restraining Order and Injunction against him which is in force, and will remain so for several years pending an appeal, unless withdrawn by Shell. I would like to convey through the medium of the Tell Shell forum my condolences in respect of the poor souls in the Gulf States of the USA who tragically lost their lives as a result of Hurricane Katrina. I pray for relatives and friends of the deceased and for the huge number of people who have lost everything and now find themselves living as refugees a long way from their homes.

There has been some criticism of the oil companies for giving alleged derisory donations to assist in the response to this unprecedented natural disaster in North America. I understand (correct me if I am wrong) that my former employer Shell has given $1 million USD. In view of recent publicly made allegations against Shell management that it has displayed racist policies towards its former employees in Malaysia (which I am sure must be unfounded), I would respectfully suggest that Shell could dispel any such notion by making a much more significant donation to the charities supporting the refugees, many of whom are impoverished. read more

The press is having a field day in devising colourful headlines about the scandal ridden Royal Dutch Shell Group. An article in “The Sunday Times” yesterday had a story under the headline: “Shell move robs UK investors”. It reported on the horrendous tax implications for UK Royal Dutch shareholders resulting from the recent Royal Dutch/Shell unification and the dubious way in which Shell has dealt with the controversy thus far.

Yesterdays “Independent on Sunday” used the term “Clever Rascals” about Shell in a headline relating to the Sakhalin project in Russia and the potential ramifications in respect of the critically endangered western grey whale. For the record, the Encarta Online Dictionary definition of a “rascal” is: “dishonest person: somebody, especially a man, who is dishonest or otherwise unethical”. read more

The Internet provides a low cost platform for anyone, even of modest means, to reach a global audience. It is the high-tech equivalent of having a soap box at “Speakers Corner” in London’s Hyde Park – that long-established bastion of free speech.

The net gives ordinary mortals the opportunity to publicly criticise the rich and powerful on what are known as “gripe” sites.

Some sites even legally use a dotcom name identical to a target company’s trademark. This is a remarkable development. It is based on a loophole which requires that the gripe site must be non-commercial with no subscriptions and no advertising involved. read more

A report published in The Sunday Times today, reveals that Shell senior management has bought three Falcon jet aircraft creating a Royal Dutch Shell plc boardroom fleet of 4 luxury executive jets.

The cash to buy the jets is being generated by the one element over which Shell management has no control – record high oil prices and consequential humungous profits. Shell recently announced profits of £5.6 billion for the first half of 2005. In other words, Shell is currently making almost £1 billion GB pounds per month (nearly $2 billion US dollars per month). read more

Information has reached us that Shell whistleblower, Dr John Huong, is in correspondence with the Scottish Authorities and has offered to give evidence to the recently announced Brent Bravo Public Inquiry into the deaths of two Shell employees on the Brent Bravo oil platform.

In April, Shell was fined £900,000 after admitting blunders leading to the deaths of two offshore workers Mr Moncrieff, of Invergowrie, Dundee, and Mr McCue, of Kennoway, Fife. Both were tragically suffocated by an escape of gas while inspecting a patch on a safety-critical pipeline in the leg of the platform. read more

Although the media has welcomed the appointment of Jorma Ollila as the new Shell Chairman from June 2006, many of the news reports about his recruitment also include references to the Shell reserves debacle. This is despite the fact that over a year and a half has passed since news first broke about the scandal.

Commentary harking back to the scandal has been a regular feature of news reports about Shell. Although Shell has paid nearly a quarter of a billion dollars in regulatory fines and litigation settlements, other litigation is still proceeding, as well as on-going investigations, so there is no prospect of negative commentary abating any time soon. There is also the matter of the pending FSA tribunal ruling in respect of proceedings brought by disgraced former Shell Chairman Sir Phillip Watts. read more

News of the latest Shell shocker – the $10 BILLION capital expenditure overrun in the Sakhalin-2 project in Russia is understandably making headlines around the globe. It is surely the biggest management oversight blunder in corporate history (if we leave the Royal Dutch/Shell reserves scandal to one side).

According to a report published yesterday in Mosnews, Royal Dutch/Shell CEO Jeroen van der Veer is claiming that he only learnt about this latest financial disaster last Wednesday and informed Gazprom on Thursday (Read the article). This implies that no Shell director was aware of the £10 BILLION OVERSPEND SURPRISE at the time of the unification AGM’s on 28 June, just 20 days ago! That is simply incredible. read more

The trial of Shell vs Dr John Huong has been adjourned to Nov 14,15,16,17 and 18.

The two-day preliminary hearing of the case saw only one witness taking the stand – Max Prins, a witness for Shell.

Dr Huong, an ex-Shell employee, is suing the company, alleging that he was unfairly dismissed. After a domestic inquiry was conducted by the company, it allegedly found the claimant to have been absent from meetings with his superior and not performing his work as instructed by his superior. The meeting was fixed by the claimant’s superior, Max Prins, every Friday morning from 7.30am to 8am. read more

MIRI: Dr John Huong, an ex-Shell employee, is suing Shell in the Industrial Court here, alleging that he had been unfairly dismissed by the company.

According to the case papers filed by his lawyer, William Ding, the claimant is requesting reinstatement to his former position in the company as a geologist. He had been working with the company for almost 30 years in various capacities.

“He was dismissed on March 28, 2003 after the company conducted a domestic inquiry, alleging that the claimant had absented himself from work and meetings on numerous occasions,” said Ding. read more

Proceedings commenced yesterday, 14 June 2005 in the Industrial Court in Miri, Malaysia, in respect of an action brought by Dr John Huong, a former Shell geologist for almost 30 years. The case went to court after all other avenues of resolving his claim were exhausted. The case continues today.

The Malaysian High Court Injunction obtained by eight companies within the Royal Dutch Shell Group regarding revelations by Dr Huong posted on this website remains in force. Dr Huong’s appeal for the action to be dismissed on grounds that it was brought against him in the wrong legal jurisdiction is pending. read more
